DescriptionThe Office of Claims and Appeals decides crime victims' compensation claims, hears and decides appeals on tax assessments, and hears and decides negligence claims filed against any Commonwealth of Kentucky state government agency.

The Office of Claims and Appeals provides legal and administrative support to the three boards that decide crime victims' compensation claims, hear and decide appeals on tax assessments, and hear and decide negligence claims filed against any Commonwealth of Kentucky state government agency or employee.
As a Staff Attorney III you will provide a variety of complex legal services which are characterized by issues which are typically unique, controversial, or technical in nature and require extensive original research and analysis; and performs other duties as required.

Experience, Training, or Skills: Must have two years experience as a licensed attorney in the practice of law.
Substitute Education for Experience: A Master of Laws degree (LL.M.) will substitute for one year of the required experience.
Substitute Experience for Education: None
Special Requirements (Age, Licensure, Regulation, Etc.): Must be admitted to practice law and in good standing in the Commonwealth of Kentucky OR comply with Kentucky Supreme Court Rule (SCR) 2.111 (limited certification of admission to practice), SCR 2.112 (attorney participants in defender or legal services programs), SCR 2.117 (practice pending admission). Must maintain any required licensure(s), certification(s), or other credentials for the length of employment in this job classification. Employing agency is responsible for ensuring employee possesses and maintains required licensure(s), certification(s), or other credentials.

As a Staff Attorney III you will provide a variety of complex legal services which are characterized by issues which are typically unique, controversial, or technical in nature and require extensive original research and analysis; and performs other duties as required.
Responsibilities include, but are not limited to, the following:
- Handles legal issues that are unique and technical in nature that may require original legal research and analysis; researches resource materials for information relevant to pending claims, appeals, and other proceedings.
- Reviews Recommended Orders prepared by Hearing Officers and CVCB Clerk; provides legal counsel and opinions to the Board Members, Executive Director, and staff on the merits of cases and advises in regard to the rendition of Final Orders in those claims, appeals, and other proceedings.
- Provides Counsel to Board Members, Executive Director, and staff regarding ongoing investigations and reviews claims to determine merits of processing in various directions. Drafts legal opinions as required; advises in legal phases of policy matters; reviews and makes recommendations on agreements, contracts, and other actions by Board Members, Executive Director, and staff.
- Prepares routine and complex pleadings in connection with claims, appeals, and other court proceedings, and makes appearances in those matters in the Kentucky courts.
- Serves on interagency and intra-agency committees as directed by the Executive Director.
- Ensures open record request are answered in a timely manner in adherence to current statutory requirements.
Preferred Skills and Abilities:
- Has a background or a strong interest in administrative law arid open records. Tax law experience preferred but not required.
- Has a positive attitude and is a self-starter.
- Is professional, competent, and polite.
- Has excellent computer skills.

Working Conditions
Duties are performed primarily in both office and courtroom settings. Travel is required.
Probationary Period
This job has an initial and promotional probationary period of 6 months, except as provided in KRS 18A.111.
