The Department of Professional Licensing ("DPL"), Legal Division, is looking for an individual with the highest level of professionalism, integrity, and excellence to become part of its dedicated and hard-working team. The DPL Legal Division provides outstanding legal services to the Department, which licenses and regulates the various regulatory Boards within the Commonwealth of Kentucky.

The DPL Legal Division represents and provides legal advice to the Department's Boards, assists with managing board related issues, coordinates with Board members regarding drafting, filing and guiding any regulatory changes along with completing the regulation promulgation process, reviews legislative bills, and represents the various Boards in administrative hearings and court litigation across the Commonwealth.

The Staff Attorney III will have the following responsibilities, including but not limited to:
  • Providing legal advice to the Department's regulatory and licensing Boards
  • Attending meetings, conducting legal research, providing timely and well-supported pleadings
  • Preparing, litigating, and arguing administrative cases, and at times instituting actions or defending the Department in administrative, district or circuit court settings
  • Drafting, reviewing, and revising proposed legislation, administrative regulations, opinions, bulletins, advisories, orders, and other documents requiring legal analysis and research
  • Responding to routine inquiries from the public
  • Responding to Open Records Requests
  • Maintaining legal files and tracking hours engaged in legal service to the Boards

Preferred Skills and Abilities:
  • Has a positive attitude, communicates well in a professional setting, problem solver and is a self- starter.
  • Has experience with Teams or Zoom meeting technology.
  • Has work-related experience in administrative law and, or, court litigation and, or, board representation.

Minimum Requirements:
Education: See Special Requirements.

Experience, Training, or Skills: Must have two years experience as a licensed attorney in the practice of law.

Substitute Education for Experience: A Master of Laws degree (LL.M.) will substitute for one year of the required experience.

Substitute Experience for Education: None

Special Requirements (Age, Licensure, Regulation, Etc.): Must be admitted to practice law and in good standing in the Commonwealth of Kentucky OR comply with Kentucky Supreme Court Rule (SCR) 2.111 (limited certification of admission to practice), SCR 2.112 (attorney participants in defender or legal services programs), SCR 2.117 (practice pending admission). Must maintain any required licensure(s), certification(s), or other credentials for the length of employment in this job classification. Employing agency is responsible for ensuring employee possesses and maintains required licensure(s), certification(s), or other credentials.

Working Conditions
Duties are performed primarily in both office and courtroom settings. Travel is required.

Probationary Period
This job has an initial and promotional probationary period of 6 months, except as provided in KRS 18A.111.
