Description of Work:
The Recruitment Range for This Position Is Limited to $130,266. Salary Offers for The Selected Candidate Are Based on The Candidate's Education and Experience Related to The Position, as Well as Our Agency Budget and Equity.

The Primary Purpose of The Special Litigation Section Is to Represent the State, Its Agencies, Officers and Employees, in Complex, Novel, Controversial or High-Profile Litigation.

The Four Primary Purposes of This Position Are as Follows:
  • To Represent the State in Elections-Related Litigation, Including Complex Litigation of Significant Importance to The State. This Litigation Takes Place in State and Federal Courts and At the Administrative, Trial and Appellate Levels. Litigation May Arise from Appeals of Decisions of The State Board of Elections Made in Contested Elections and In Campaign Finance Investigative Hearings, or In Fulfilling Other Statutory or Administrative Duties.
  • To Advise the State Board of Elections and Its Staff on Legal Questions Involving Their Duties, Rights and Responsibilities with Respect to Elections Administration and Campaign Finance. This Advice Often Takes the Form of Directives or Opinions Drafted for Issuance by The Executive Director of The State Board to Local Elections Officials, Candidates and Political Committees.
  • To Respond to Inquiries from Candidates, Political Committees, Political Parties, County Elections Officials and Other State and Local Officials, and The General Public on Elections Issues, Public Records Laws and Open Meeting Requirements. Responses Range from Formal Advisory Opinions to Informal Telephone Communications. This Position Is Expected to Review and Comment on Draft Legislation upon Request.
  • To Educate Elections Officials and Other About Legal Requirements in Elections. the State Board of Elections Is Required to Conduct Regular Training Programs for Elections Officials and This Position Provides Written and Oral Programs on Compliance with Legal Requirements as Part of That Training Effort. in Addition, the Attorney in This Position Is Regularly Requested by Other Attorneys in This Office, the Sbi or District Attorneys for Explanation of Election Law Requirements.

  • Ability to Conduct Complex Civil or Criminal Litigation in Trial and Appellate Courts.
  • Ability to Interpret and Apply Laws, Constitutional Provisions, Statutes, Administrative Regulations, and Court Decisions.
  • Ability to Determine Issues in Various Cases.
  • Ability to Creatively Develop Case Strategy and Tactics.

Minimum Education and Experience Requirements:
Licensed to Practice Law by The North Carolina State Bar and Five Years of Progressively Responsible Professional Legal Experience.

Carolina in All Litigation Unless Another Statute Specifically States Otherwise.
