Description:

**This position will be filled provisionally pending Civil Service Training and Experience Examination.**

Minimum Qualifications: Four (4) years' experience in the practice of law, two (2) years of which must have been in social services law.

Special Requirement: Admission to the Bar and possession of license to practice law in New York State.

Examples of Work:
  • Provides legal advice to various divisions of the Department of Social Services, such as Social Service Law, Medicaid, Child Welfare, Child Support, Disability Rights and other programs within the department;
  • Represents the Department of Social Services in Family Court Matters such as child abuse and/or neglect, foster care, adoption, termination of parental rights, appeals, adult protective services and related programs;
  • Prepares a variety of legal documents such as neglect/abuse petitions, orders, appeals, briefs, opinions, contract and various other legal documents to initiate Family Court intervention.
  • Screens neglect, abuse, termination of legal rights and other cases for legal sufficiency;
  • Directs and monitors legal activities in child support paternity actions including attending court, trying paternity cases, and the handling of subsequent appeals by DSS Attorney assigned to function;
  • Provides legal guidance and administrative oversight to Legal Staff, Commissioner, division heads, supervisors and other staff relative to interpretation and application of social welfare and/or related laws and regulations relating to the multitude of mandated programs administered by the department;
  • Works closely with State and Federal agencies in establishing, interpreting and administering agency regulations;
  • Acts as the County Medicaid Attorney regarding eligibility legal issues, liens, claims, recoveries, fair hearings and litigation;
  • Assists with Fair Hearings regarding medical assistance with public assistance recovery claims/liens;
  • Prepares written legal services triage schedule as needed;
  • Assigns and oversees recovery work regarding Medicaid, Cash Assistance, Safety Net and other departmental programs;
  • Performs a variety of related activities as required.
