FMR LLC is seeking an experienced attorney with deep expertise in health and welfare benefits to join our legal team. As Senior Counsel in this highly visible role, you'll serve as a trusted strategic advisor to Fidelity's healthcare businesses, including HSA, FSA and benefit administration recordkeeping, as well as Fidelity Medicare services, partnering with leaders across product, risk, compliance, technology, operations, sales, relationship management, and client-facing teams.

The Expertise and Skills You Bring:
The role calls for the following experience and expertise:
  • JD and 8 plus years of law firm, industry, government, or regulatory practice with Employee Benefits, Health and Welfare, Healthcare, or related focus.
  • Considerable experience advising on health and welfare plans and related benefits administration services.
  • Specific areas of concentration: ERISA; COBRA; HIPAA; HITECH, CAA (Group Health Plan provisions); Reimbursement Accounts, including FSA, LSA, DCAP, commuter; Section 125; HSAs; ACA; Transparency Rules; Interoperability Rules.
  • Experience drafting, reviewing, and negotiating commercial agreements involving clients, service providers, financial institutions, healthcare carriers, technology providers, and strategic partners.
  • Experience advising on healthcare privacy and data protection matters, including HIPAA Privacy, Security, and Breach Notification Rules, state health privacy laws, data-sharing arrangements, consumer health information, and emerging privacy requirements applicable to healthcare and benefits administration services.
  • Experience with Medicare, broker/dealer, banking, and/or securities law is a plus.
  • Admitted to practice or willing to secure bar admission in the relevant jurisdiction.

The following experience is strongly preferred:

  • Experience supporting healthcare payment solutions and debit card programs associated with HSAs, FSAs, and other reimbursement accounts.
  • Experience advising on privacy, digital health, artificial intelligence, cybersecurity, interoperability, and emerging healthcare technologies.
  • Familiarity with banking, broker/dealer, securities, fintech, or other financial services regulatory frameworks.

  • You act as both a builder and guardian, working with the legal team to help the business achieve strategic objectives while appropriately identifying, managing, and mitigating legal and regulatory risk.
  • You partner with business leaders to develop strategies for addressing complex legal, regulatory, operational, and commercial matters.
  • You provide subject matter expertise and timely legal advice regarding health and welfare benefits products and services.
  • You counsel business teams regarding federal and state laws, regulations, and industry developments impacting healthcare, employee benefits, reimbursement accounts, and Medicare businesses.
  • You support HSA and FSA debit card programs, including legal issues associated with program management, vendor oversight, banking relationships, network rules, and operational processes.
  • You assist with implementation of new clients and new product offerings, including service offering changes driven by legislative, regulatory, and market developments.
  • You help foster innovation by providing practical, risk-balanced solutions that support the delivery of world-class experiences for Fidelity's customers and clients.
