The Senior Legal Counsel provides legal advice and compliance support across (Direct Crae and Treatment) DCT on complex and evolving areas of law and policy, with a focus on data privacy and data security issues affecting DCT's client population and operations. The role advises senior leaders, including executive leadership, and staff to support compliance with applicable state and federal data privacy and security laws governing the collection, use, sharing, and protection of client data, including assisting with thorough data review and lawful redaction of records to ensure compliance and protect sensitive information.
This position also leads legal and policy research and analysis and provides legal advisement on matters related to DCT policymaking and program administration; legislative initiatives; contracts and data-sharing agreements; employment matters; investigations and audits; litigation-related support; privacy and security training; and compliance with departmental policies and controlling legal authority

Primary Responsibilities:
- Provide legal advice and compliance support to DCT senior leadership, managers, and staff on complex and evolving legal and regulatory issues, including data privacy, data security, and compliance with state and federal laws such as HIPAA and the Minnesota Government Data Practices Act.
- Assist the agency in reviewing, redacting, and managing sensitive data and records to ensure compliance with applicable laws and protection of client information.
- Conduct legal research and policy analysis, advising on the development, interpretation, and implementation of DCT policies and procedures.
- Counsel DCT on legislative initiatives, contracts, data-sharing agreements, and operational matters that impact legal and regulatory compliance.
- Collaborate with internal and external stakeholders, including agency partners, contractors, MNIT, and other government legal offices, on strategic initiatives related to data protection, data sharing, and compliance management.
- Provide guidance and support during investigations, audits, and other compliance reviews.
- Assist in developing and delivering legal and compliance training for DCT leadership and staff.
- Provide broad legal support across DCT on complex, varied, and evolving matters to help ensure the agency's adherence to all applicable state and federal laws and regulations.
Qualifications:
Minimum Qualifications:
- Juris Doctor (JD) degree from an ABA-accredited law school; AND
- Current license and good standing to practice law in Minnesota; AND
- Four (4) years of experience as a practicing attorney in data privacy and/or administrative law, regulatory compliance or a related field. Experience must demonstrate:
- Interpreting and applying state and federal laws, including HIPAA, affecting human services or public sector programs
- Experience with Minnesota Government Data Practices Act, Health Insurance Portability and Accountability Act, and Health Information Technology for Economic and Clinical Health Act
- Public sector legal experience
- Responding to data requests, compliance inquiries, or regulatory matters, and building effective working relationships with internal and external stakeholders
Preferred Qualifications:
- Demonstrated ability to provide leadership through organizational or regulatory change
- Strong analytical, strategic thinking, and problem-solving skills
- Experience analyzing operational or performance data to identify risks or process improvements
- Demonstrated ability to communicate effectively with diverse stakeholders, including policymakers and agency leadership
- Experience using Everlaw or similar e-discovery/document review platforms
- Commitment to cultural responsiveness and experience working effectively with individuals from diverse backgrounds and cultures
