Opportunity:The Senior Counsel – Construction will be a valued member of the Legal team of the North American division of An Infrastructure Solution Company. We are looking for an outstanding attorney who can operate independently yet very collaboratively with business leads, the General Counsel, and the senior executive team.
The Senior Counsel – Construction needs to be an agile, team-focused individual, with proven professionalism, who is comfortable in a rapidly changing environment. The right person is highly organized, detail-oriented, self-motivated, has excellent communication skills, can think strategically, and works equally as well independently as with a team. Key Responsibilities:
Include but are not limited to:
- Provide legal counsel across all phases of data center construction, including design, execution, and commissioning
- Lead negotiations of EPC, GMP, design-build, and fixed-price contracts with design partners and general contractors
- Lead negotiations of development agreements and work letters for hyperscale build-to-suit leases
- Handle legal matters related to construction claims, liens, delays, defects, and site safety compliance
- Produce and maintain best-in-class contract forms for design and construction engagements
- Manage outside counsel
- Work with business leads, the General Counsel and the senior executive team to continually refine processes
- Serve as a trusted thought partner to business leads, the General Counsel, and the senior executive team
- Support other corporate and commercial matters identified by the General Counsel, as needed
- Ensure compliance with relevant regulations, standards, and company policies
Skills & Requirements:
Education / Experience:
- Juris Doctor from an accredited U.S. law school with strong academic credentials
- Membership of the Bar of at least one U.S. state or the District of Columbia
- 8+ years of legal experience, including meaningful experience negotiating construction and design contracts across various project delivery methods. Experience at a major law firm and as in-house counsel is highly preferred.
- Has routinely supported large-scale data center developers or customers in negotiations of construction and design contracts
- Other experience in the data center/digital infrastructure industry will be viewed positively, including experience with land use and entitlement matters, power procurement, and customer leases and master services agreements
- Self-directed, able to make decisions, and manages time well
- Effective, tactful, friendly, and high-integrity negotiation skills, both verbally and in writing
- Able to build genuine, trusting relationships with business leads
- Analyzes and balances legal risk with an eye towards the ultimate business goal
- Outstanding written and oral communication skills, good listener, and always receptive to constructive feedback
- Enthusiastic about challenges, comfortable with change, and eager to learn
- Works well under pressure, meets deadlines, and sees projects through to completion
