A Consumer Healthcare Products Company is recruiting for a Senior Counsel, Patent Litigation, located in New Brunswick, New Jersey. This role offers a flexible hybrid model (3 days on-site per week with the option to work up to 2 days remote).

As Senior Counsel within the Litigation Group of the Global Legal Organization at A Consumer Healthcare Products Company, you will report into the Global Head of IP Litigation. You will advise and represent the company and each of its two sectors (Innovative Medicine and MedTech) in patent and other IP litigation around the world. You will be joining a fast-paced and growing team tackling novel legal issues, to enable the company to do what it does best, namely care for patients around the world.

As a Senior Counsel for Patent Litigation, you will:
  • Strategically manage a large portfolio of complex patent litigation in the United States and abroad
  • Select and manage outside litigation counsel
  • Partner closely with third-party partners, company management, patent attorneys, and other personnel to work collaboratively in support of litigation
  • Counsel company management concerning patent, regulatory, and product exclusivity issues
  • Actively manage litigation budgets, partnering closely with outside counsel, litigation vendors, and the internal finance team
  • Develop strategies to resolve disputes, including negotiating and drafting complex patent settlement and license agreements
  • Contribute to cross-functional or departmental projects and initiatives

Qualifications:
  • A Juris Doctor Degree and admission to and in good standing with at least one state bar is required.
  • A minimum of 10 years of experience in complex patent litigation is required.
  • Experience handling all aspects of pre-trial case preparation and management including discovery, witness preparation, writing and review of major briefs, and selection of experts and preparation of expert reports is required.
  • Experience managing litigation budgets is required.
  • Experience managing multiple complex matters simultaneously in multiple jurisdictions is required.
  • Trial experience is required.
  • Experience negotiating settlements is preferred.
  • Substantial experience with ANDA and BPCIA litigation is preferred.
  • Experience with inter partes review proceedings before the PTAB at the USPTO is preferred.
  • Experience developing sound, clear, practical legal advice in a business setting and/or to business clients
  • The ability to work across business functions and cultures with teams across multiple time zones and independently in a fast-paced environment is required.
  • Must be available for moderate travel within the US and occasional travel outside the US.
