This Senior Counsel, Data & Privacy position is a new position that resides in the Legal team to serve as the primary legal advisor to support Vistra's overall data governance program, including but not limited to privacy, artificial intelligence, and cybersecurity. Senior Counsel will work with fellow Legal and Compliance professionals and internal business units to support the needs of our business.

Job Description:
Key Accountabilities:
  • In collaboration with Technology Services, Compliance and other business units, develop a data management compliance program including training, and maintenance of policies and standards
  • Proactively provide timely advice, counsel and guidance to internal business stakeholders on various laws, rules, regulations and internal policies and procedures in data management areas
  • Draft, review, and negotiate data management terms in various operational service and commercial contracts
  • Support leadership, business units, and external counsel and third parties in any cyber-related event
  • Manage and/or support external counsel in data management-related disputes and litigation

Education, Experience & Skill Requirements

  • Juris Doctor degree from an accredited U.S. law school required.
  • Active U.S. State Bar license and member in good standing required.
  • Minimum of 7 years' legal experience in U.S. federal and state data management laws required, including but not limited to data privacy, artificial intelligence, and/or cybersecurity
  • Data privacy certifications such as IAPP-CIPP/US preferred
  • Strong written and verbal communication skills, including the ability to handle multiple projects in a fast-paced work environment

  • Maintain knowledge of applicable laws, rules and regulations as well as retail compliance best practices
  • Favorable negotiation and settlement of any data management-related disputes and litigation
  • Increased awareness of data management risks and mitigation through successful training initiatives
