An American Multinational Medical Devices and Health Care Company is currently seeking an experienced attorney to join our Commercial Legal Operations team in the position of “Senior Counsel” supporting An American Multinational Medical Devices and Health Care Company Diabetes Care/ Lingo in Alameda, California.What You'll Do:
As a member of the legal team supporting An American Multinational Medical Devices and Health Care Company Diabetes Care/Lingo, the attorney will provide legal guidance to a fast paced, rapid-growth, patient-centric, and dynamic business unit across a variety of legal topics and geographies. The individual will collaborate with many aspects of the business, including: marketing, sales, business development, customer service, purchasing, supply chain, clinical, regulatory, and quality, to provide top notch legal advice and drive positive outcomes for An American Multinational Medical Devices and Health Care Company and the people who rely on its products.
This individual also will be an integrated part of a larger diverse Commercial Legal Operations team that works across An American Multinational Medical Devices and Health Care Company divisions to build and grow successful relationships with business partners, outside attorneys and professionals, and customers.
This position reports to Divisional Vice President An American Multinational Medical Devices and Health Care Company Diabetes Care.
Position Duties:
- Participate in the preparation and negotiation of US and global business development partnerships, commercial contracts, and agreements with: hardware and software companies, health care professionals, suppliers, and researchers.
- Advise marketing and commercial teams on advertising and promotional practices, claims, social and digital media guidelines, engagement with influencers and celebrity endorsements, including with respect to Federal Trade Commission and other global regulations.
- Provide risk management advice and legal support for the corporate incident response and customer service teams on global issues.
- Provide legal counsel on compliance, risk management, and other legal issues in the context of federal and state regulatory requirements, including federal consumer protection laws, fraud and abuse laws, Anti-Kickback issues, Sunshine law, False Claims Act and Foreign Corrupt Practices Act.
- Supervise and direct outside counsel as needed.
- Work in close cooperation with An American Multinational Medical Devices and Health Care Company's compliance, intellectual property and privacy organizations to develop strong legal outcomes.
- Identify training needs and assist in development and presentation of training and education regarding legal requirements and developments.
- Develop understanding of and familiarity with: An American Multinational Medical Devices and Health Care Company's business, its people, products, markets, facilities, customers, and competitors, and use this knowledge in providing guidance and counsel to An American Multinational Medical Devices and Health Care Company Diabetes Care/Lingo.
- Infrequent and minimal travel may be required (10-15%).

Training/Experience Required:
- Possess a Juris Doctor Degree from An Accredited Law School, Demonstrate a Strong Academic Background, and Be Admitted to A Us State Bar in Good Standing.
- Eight or More (8+) Years of Experience as A Commercial Attorney at A Top Law Firm And/or In-House, Including the Provision of Legal Advice on Commercial Matters And/or Drafting/editing Commercial Contracts.
- Ability to Handle Multiple Projects in Fast-Paced Environment and Exercise Sound Commercial and Legal Judgment.
- Strong Process and Analytical Skills.
- Excellent Problem-Solving Ability.
- Excellent Time Management Skills and Ability to Manage Competing Priorities While Ensuring Timely Completion and Follow Up.

Preferred Experience:
- At Least Eight (8) Years of Progressively More Responsible Work Experience in The Health Care or Tech Industry, at A Top Law Firm, or In-House and Working.
- Experience with Navigating Federal Trade Commission Issues in The Us.
- Experience Representing an Fda-Regulated Company, Including Knowledge of Federal Consumer Protection Laws, Fraud and Abuse Laws, Anti-Kickback Law, Adva Med Code, Hipaa, Gdpr, and Other Laws and Regulations Pertaining to The Global Pharmaceutical or Medical Device Industry.
- Medical Device, Digital Health, Pharmaceutical or Other Health Care Business Experience, And/or Software Experience.
