Bay Legal is one of California's fastest-growing law firms, and we are building a plaintiff-side probate and trust litigation practice to meet a market that is growing fast. The Great Wealth Transfer is generating a surge in contested estate and trust matters across California — will and trust contests, elder financial abuse claims, breach of fiduciary duty, trustee removal, and conservatorship disputes. We want an attorney who can run these cases.

If you know the California Probate Code inside and out, can take a contested matter from petition through trial, and want to build a practice rather than fill a seat, we would like to talk.

The Role:
You will handle plaintiff-side probate and trust litigation across California. Your caseload will include will and trust contests, undue influence and elder financial abuse claims, breach of fiduciary duty, trustee removal petitions, accountings and surcharge actions, and conservatorship disputes. You will manage your own matters, work with paralegals and junior attorneys, and build the referral relationships that drive the practice.

The firm handles non-contested probate on a statutory fee basis under California Probate Code  10800 and 10810. Probate disputes, trust administration, and trust beneficiary litigation are handled hourly. You will be expected to generate collections that support the firm's growth and earn performance bonuses above your collections threshold.

This is a full-time, exempt, W-2 position.

Who we are looking for:
  • Active California State Bar member, in good standing
  • Minimum 5 years of California civil litigation experience, with substantial time in probate, trust, or estate matters
  • Solid working knowledge of the California Probate Code, Code of Civil Procedure, and Evidence Code
  • Experience with depositions, motion practice, and mediations in the probate court context
  • Plaintiff-side experience preferred; defense-side candidates with strong litigation skills and willingness to transition considered
  • Self-directed in a remote environment and motivated to develop referral relationships and grow a practice
