Overview:We are seeking an experienced Probate and Estate Planning Attorney to join our firm in Tempe, Arizona. In this pivotal role, you will be responsible for providing comprehensive legal services to clients in the areas of probate, estate planning, business succession planning, and wealth transfer strategies. Your primary duties will include drafting wills, trusts, powers of attorney, and other essential estate planning documents, as well as guiding clients through probate/trust administrations. This position requires expertise in developing customized estate plans to meet each client's unique goals and objectives and in-depth knowledge of Arizona probate laws and rules of procedure. The ideal candidate will demonstrate a commitment to excellence, ethical practice, and continuous professional growth in this dynamic area of law.
Duties:
- Advise and guide clients through various types of uncontested probate matters (i.e. small estates, informal probates, formal probates, guardianships, conservatorships, single transaction authority, estate/trust administrations, etc.) .
- Draft pleadings (re probate services) and represent clients in court proceedings.
- Draft comprehensive estate plans, such as Trusts (revocable and irrevocable), Last Wills, POAs for health & finances, Living Wills, HIPPA Releases, Funding documents (assignments, deeds, Articles of Amendment, etc.). Plans may include tax strategies and asset protection.
- Draft Business Succession Plans.
- Draft business formation, maintenance and sales docs.
- Collaborate with other attorneys and staff within the firm to ensure comprehensive legal representation for clients.
- Stay updated on changes in laws and regulations that may affect client cases.
- Communicate effectively with clients to explain legal options and processes.
Skills:
- Proficiency with A.R.S. Title 14 and Arizona Rules of Probate/Civil Procedure.
- Understanding of tax/gifting laws.
- Proficiency in MS Word, Adobe, WealthCounsel, Lexis-Nexis, Clio.
- Exceptional writing skills for drafting clear and persuasive legal documents.
- Ability to analyze complex legal issues and develop effective strategies.
- Strong organizational skills with attention to detail in managing case files and documentation.
- Excellent communication skills for interacting with clients, colleagues, and court personnel.
