Position Summary: The Pre-Litigation Attorney will be responsible for handling personal injury cases before they enter litigation. This role involves evaluating, investigating, and managing injury claims, negotiating with insurance companies, defense counsel, and working closely with clients to secure settlements.

Key Responsibilities:
  • Review potential new personal injury cases, evaluate their merit and potential value, and make recommendations for further action.
  • Work with the pre-litigation case managers to review case documents, including medical records, police reports, and witness statements, to establish liability and damages.
  • Conduct investigations, including speaking with clients, witnesses, and experts, to gather evidence and determine the strength of each case.
  • Maintain regular communication with clients, providing updates on their case status, explaining legal options, and offering guidance throughout the pre-litigation process.
  • Negotiate directly with insurance adjusters, opposing parties, and other stakeholders to secure settlements for clients.
  • Draft settlement offers, and other legal correspondence apart of the negotiation and settlement process.
  • Monitor and track key deadlines, including statutes of limitations, to ensure all legal requirements are met within the pre-litigation phase.
  • Collaborate with pre-litigation case managers and other attorneys to manage and organize case files, ensuring all relevant information is properly documented and easily accessible.
  • Stay informed on developments in personal injury law, including insurance practices and industry trends, to ensure the best possible outcomes for clients.

Qualifications:
  • Juris Doctor (JD) from an accredited law school
  • Current member and in good standing of the Illinois Bar
  • A minimum of 3+ years of experience in personal injury law, with a strong focus on pre-litigation case management
  • Proven experience negotiating settlements with insurance companies and managing claims in the pre-litigation phase
  • Strong communication, negotiation, and writing skills
  • Excellent organizational skills with the ability to manage multiple cases and deadlines
  • Empathy and professionalism in client interactions, especially in sensitive and high-stress situations
  • Knowledge of personal injury law, insurance procedures, and relevant legal requirements
  • Experience in a high-volume personal injury practice
  • Familiarity with Filevine

Chicago Pay Range
$120,000 - $175,000 USD

Physical Requirements:
  • Office environment with normal business hours necessary to satisfactorily perform job functions.
  • Stationary Position – Must be able to remain in a stationary position up to 50% of the time.
  • Move or Traverse – This position needs to occasionally move about inside the office to access file cabinets, meeting rooms, office machinery, etc. May occasionally ascends/descends the stairs to get to other floors, cafeteria and parking area.
  • Dexterity – constantly operates a computer and other office machinery such as a copy machine/printer.
  • Move, Transport, Position, Put, Install, Remove - Occasionally moves supplies weighing up to 10 pounds for various presentation and event needs.
  • Communicate, Detect, Converse with, Discern, Convey, Express oneself, Exchange information - The ability to communicate information and ideas so others will understand. Must be able to exchange accurate information in these situations.
  • Detect, Determine, Perceive, Identify, Recognize, Judge, Observe, Inspect, Estimate, Assess - The ability to observe details at close range (within a few feet of the observer).
