Established by the 69th Legislative Assembly, The Pharmacy Benefits Manager (PBM) Division is a newly created division under HB 1584 to support North Dakota's newly enhanced regulatory framework for PBMs. The bill strengthens oversight of PBMs by establishing licensing requirements, prohibiting unfair practices, expanding enforcement authority, and improving transparency in prescription drug pricing and rebate structures. The role contributes directly to protecting consumers, ensuring fair market practices, and enforcing compliance with state PBM laws.

Summary of Work:
The North Dakota Insurance and Securities Department is seeking a dedicated and experienced attorney to support its Pharmacy Benefits Manager (PBM) Compliance Program. This role involves providing legal counsel, conducting regulatory examinations and investigations, and prosecuting violations of state PBM and insurance laws. The PBM Attorney will play a critical role in ensuring consumer protection and regulatory compliance in North Dakota's evolving insurance and pharmaceutical benefits landscape.

Duties and Tasks
Conduct Regulatory Investigations and Legal Proceedings
Examine and investigate PBMs and related entities; prepare and prosecute administrative and civil enforcement actions; draft legal documents; present arguments before tribunals and courts; and negotiate resolutions.

Legal Counsel and Policy Guidance
Provide legal advice to the Insurance Commissioner, agency leadership, and staff on PBM and insurance statutes, rules, and regulations. Respond to legal inquiries from legislators, stakeholders, and the public.

Policy and Rule Development
Draft and review legislation, administrative rules, and agency guidance. Monitor and analyze state and federal legal developments affecting PBM regulation and recommend policy responses.

Collaboration and Representation
Collaborate with internal staff, other state and federal agencies, and national insurance regulators. Represent the Department in National Association of Insurance Commissioners (NAIC) working groups and external stakeholder meetings.

Education and Outreach
Provide training and presentations on PBM compliance and insurance law to Department staff, legislators, and stakeholders. Participate in continuing education and regulatory conferences to maintain subject matter expertise.

Minimum Qualifications:
  • Juris Doctor (J.D.) from an accredited law school.
  • Active membership (in good standing) with the North Dakota Bar, or eligible for admission by reciprocity within six months of hire.
  • Minimum of three years of professional legal experience in one or more of the following areas: regulatory compliance, administrative law, litigation, pharmaceutical law, health care law, insurance law, or related legal fields.
  • Experience preparing and presenting cases in administrative or judicial proceedings is preferred.
