About the Opportunity:Rosner Russo Shahabian, an established plaintiff-side personal injury firm, is seeking an experienced litigation attorney to lead our complex litigation and nursing home negligence practice. This is a meaningful opportunity for an attorney who is passionate about advocating for society's most vulnerable, including elderly and disabled residents and handling more complex negligence matters.
The right candidate will take ownership from inception intake through resolution, working alongside a collaborative team of attorneys, paralegals, and support staff who are committed to securing justice for our clients and their families.
Key Responsibilities:
- Manage an active caseload of nursing home negligence and abuse matters in New York state and federal courts, from case evaluation and filing through settlement.
- Manage a smaller case load of complex negligence matters ranging from automobile to labor law.
- Handle all litigation including depositions, court appearances, and motion practice.
- Assist the Trial Department with preparation and presentation of trials. Trial work is encouraged but not required.
- Participate in internal file reviews, litigation strategy meetings, and firm trainings
Requirements:
- Active New York bar license in good standing
- Minimum of 7 years of plaintiff-side personal injury litigation experience
- Demonstrated background in nursing home negligence and abuse litigation is required, including familiarity with Public Health Law 2801-d, federal and state nursing home regulations, and medical record review
- Experience handling automobile, trip and fall, construction accident and complex personal injury matters involving experts.
- Ability to independently manage an active caseload from filing through resolution.
- Strong written and verbal communication, negotiation, and legal research skills
- Compassionate client service skills, with the sensitivity required to work with elderly clients and grieving families
- Deposition and courtroom experience; trial experience a plus but not a requirement
- Experience with wrongful death and catastrophic injury claims
- Familiarity with medical records, MDS assessments, care plans, and DOH survey and citation history
- Comfortable preparing witness, taking and defendant depositions
- Experience opposing complex motions and handling oral arguments
- Experience directing paralegals and support staff
- Broader plaintiff-side personal injury experience (premises liability, medical malpractice, or similar)
Compensation & Benefits:
- Base salary of $175,000 – $250,000, commensurate with experience and book of business
- Origination fee of 33% for all negligence matters brought into the firm.
