Description:

About the role:
Sargent Law Firm is hiring a personal injury attorney for our Oceanside office. You'll carry a caseload of roughly 70–120 active files, depending on experience and case phase, at a time, from pre-litigation through resolution: building claims, negotiating with carriers, and litigating when a case needs to be filed. Our attorneys work about 40 hours a week, and compensation is tied to the cases you resolve.

About Sargent Law Firm
For more than 15 years, Sargent Law Firm has represented injured people and families throughout Southern California and Idaho. Our practice covers car, trucking, and motorcycle accidents, dog bites, and premises liability.

Our Vision: To positively impact the lives of our clients and local communities through service.
Our Mission: To help people who have suffered injury or death by providing access to the highest level of legal representation, medical treatment, and financial compensation.

What we offer:
  • Base salary plus a production bonus. Base pay ranges $90,000–$120,000 depending on experience. The bonus is based on fees produced.
  • Origination credit. A referral bonus equal to ⅓ of net attorney fees on new matters you bring to the firm, in accordance with State Bar rules.
  • A reasonable schedule. Roughly 40-hour weeks, with cases staffed so the workload is manageable.
  • Dedicated support staff. Paralegals and case managers are assigned to your cases.
  • Modern systems. We're a Mac-based office running Filevine, and we're actively integrating AI tools into case workup.
  • Benefits. Health, dental, and vision insurance; paid time off and holidays; CA Bar dues and MCLE reimbursement.

Responsibilities:
Pre-Litigation
  • Evaluate new cases for liability, damages, and coverage
  • Monitor client treatment and gather medical records and bills
  • Prepare demand packages and negotiate settlements with adjusters
  • Decide with the team when a case should be filed

Litigation:
  • Manage a litigation caseload from initial filing through trial
  • Draft and argue motions; handle written discovery and discovery disputes
  • Take and defend depositions
  • Prepare for and attend mediations, arbitrations, and settlement conferences
  • Work up cases for trial, including experts, damages, and trial prep
  • Negotiate resolutions with carriers and defense counsel

Across Both

  • Direct the paralegals and case managers assigned to your cases on case strategy and deadlines (this is case-level direction, not personnel management)
  • Maintain accurate, deadline-driven case files and calendars

Qualifications:
  • Active member of the California State Bar in good standing (required)
  • 2+ years of personal injury experience in pre-litigation, litigation, or both. Strong litigators from other practice areas are also welcome to apply, provided they're ready to ramp up quickly on PI-specific work (demand prep, liens, medical record review)
  • Strong legal writing, negotiation, and communication skills
  • Comfortable with technology. You'll work in Filevine daily and use AI tools in case work, so you should pick up new software quickly. Filevine experience is a plus
  • Highly organized, with a disciplined approach to deadlines
  • A self-starter who works well on a team and cares about the clients we represent

How to Apply:
Submit your resume and cover letter. Please don't call or visit the office; we'll reach out to schedule interviews after reviewing applications.
