Fisher Phillips' Portland, ME office is expanding, and we are seeking an attorney with 4+ years of litigation experience to join our industry-leading restrictive covenants and trade secrets practice group. This is a partner-track opportunity to work with attorneys in Portland and across the firm who focus on restrictive covenants, non-compete agreements, trade secrets, and employee mobility matters on a national and international basis.About the role:
You will work closely with members of the firm's restrictive covenants and trade secrets practice group to handle matters involving covenants not to compete, non-solicitation and non-disclosure agreements, unfair competition, employee raiding and team moves, trade secrets, duty of loyalty, the U.S. Defend Trade Secrets Act (DTSA), the U.S. Computer Fraud & Abuse Act (CFAA), and various state trade secrets and unfair competition statutes. Duties are likely to include:
- Litigation matters enforcing or defending non-competes, covenants not to solicit clients, or allegations of trade secret misuse or misappropriation.
- Handling multi-state and cross-border matters involving the law of multiple U.S. states and, at times, other countries laws.
- Enterprise-wide contract drafting projects cutting across multiple states or countries
- Providing strategic planning, advice and counseling when employers are onboarding key recruits who owe legal duties to their former employers.
- Frequent legal research projects on a national and sometimes international basis.
- Working collaboratively with Portland-based partner and other practice group members throughout the US, UK and elsewhere.
What We're Looking For:
Successful candidates will bring:
- Aa strong litigation background and an interest in developing or continuing to grow a practice focused on restrictive covenants and trade secrets.
- Experience in this practice area is a plus but not required.
- Relevant experience may include handling motions for temporary restraining orders and other injunctive relief, expedited discovery, written discovery, taking and defending depositions, and matters involving computer forensics and e-discovery.
- Also helpful is experience handling motions to dismiss, motions for summary judgment or other complex motions that require substantial research and briefing.
The successful candidate will join a growing firm-wide practice group and have the opportunity to work with and receive mentoring from experienced practitioners, not only in Portland, but also throughout the firm's US and international offices. The team represents national and local companies across a wide range of industries, including financial services, medical devices, pharmaceuticals, life sciences, apparel, insurance and benefits, staffing and PEO services, healthcare, security and automation, and other sectors.
Candidates must have excellent academic credentials, strong writing and analytical skills, and the ability to manage multiple matters and priorities in a busy but highly collaborative environment. A portable book of business is not required.
Admission to the Maine Bar is required - - must have it or be willing to apply and get it.
