Job Description:
A Men's Clothing Store is looking for a proactive, business-minded Marketing Counsel to support our dynamic and growing marketing, content, and partnerships functions. This attorney will be a key advisor to the brand, offering practical guidance on content production, events & activations, advertising & promotions, and charitable giving.

What you'll get to do:
  • Draft, review, and negotiate a wide range of marketing-related agreements, including those for content production, influencer and talent partnerships, events and activations, sweepstakes, charitable campaigns, and more.
  • Support content production by advising on talent releases, production services, music licensing, usage rights, and compliance with social media platform policies.
  • Provide legal support for events and activations, including co-marketing, sponsorship, venue agreements, and brand safety best practices.
  • Advise on influencer, creator, athlete, and ambassador partnerships in compliance with FTC Endorsement Guidelines and truth-in-advertising laws.
  • Counsel on contests, sweepstakes, and giveaways, including drafting official rules, disclosures, and ensuring compliance with applicable laws.
  • Advise on privacy and data protection issues related to marketing campaigns, including email marketing, data collection, and targeted advertising.
  • Review advertising claims, sustainability messaging, and promotional content to ensure compliance with consumer protection and IP laws.
  • Support charitable marketing initiatives, including donation agreements, commercial co-ventures, and related disclosure and registration requirements.

Qualifications:
Who You Are:
  • J.D. and active membership in at least one U.S. state bar (CA preferred).
  • 7+ years of legal experience, ideally with a strong foundation in marketing and/or entertainment/media.
  • Familiarity with:
  • FTC and state consumer protection laws
  • U.S. privacy laws (e.g., CCPA, CAN-SPAM)
  • Trademark and copyright issues in commercial content
  • Talent agreements and publicity rights
  • Music licensing (sync, master use, PROs) in advertising and digital content
  • Commercial co-ventures, charitable sales promotions, and related disclosure requirements
  • Clear and concise contract drafting and negotiation skills.
  • Exceptional judgment, with the ability to weigh legal risk against creative and business goals.
  • Entrepreneurial, collaborative, and highly organized -- thrives in a fast-paced environment.
  • Experience working in-house at a consumer brand or with lifestyle/retail clients is a plus.
