Job Summary:This position specifically focuses on the areas of Healthcare and Community-Based services and is responsible for development and management of long-range priority initiatives for Disability Rights Florida when it comes to topics such as Medicaid, community integration, housing, and rights restoration. The managing attorney demonstrates significant legal experience and is instrumental in delivering the legal services necessary to achieve case and project objectives. This position involves highly responsible work assisting the Team Director with team operations, legal analysis, managing and litigating cases, planning and staff development, administrative duties necessary to manage the team, cross team projects, and review of program outcomes. The Managing Attorney may be responsible for direct supervision of the work of support staff, advocate/investigators, staff attorneys, senior staff attorneys, legal interns or others. The Managing Attorney is expected to appear in administrative hearings, state and federal courts, state agency and legislative meetings in addition to providing education, outreach and other services related to disability issues. The Managing Attorney is capable of independently handling complex legal matters, as well as providing mentoring and routine guidance to less experienced attorneys. The Managing Attorney may work with the Team Legal Director to develop litigation initiatives, advise senior leadership on organizational procedures and programs and provide organizational legal guidance.
Essential Duties:
- Ensures that the rights of people with disabilities as provided for by law and regulation are enforced.
- Uses best practices to manage investigations and to resolve complaints of rights violations or complaints of abuse or neglect.
- Demonstrates a command of law and legal procedure as well as relevant legislative, administrative and regulatory policy and procedure, monitors trends in litigation and policy development and conducts research utilizing multiple resources.
- Significant legal/litigation experience in state and federal courts to include client contact, complex motion or appellate practice and litigation through jury or non-jury resolution.
- Independently conducts legal research and drafts high quality pleadings and motions, conducts discovery, and presents legal arguments in court.
- Provides supervision or guidance to staff attorneys, advocates, paralegal and support staff in litigation planning and organization.
- Prepares publication ready written reports for internal and external distribution, including executive summaries and recommendations.
- Acts with utmost commitment to the code of professional conduct and ethics and sets an example for professional conduct of staff.
- Participates in outreach and education of DRF constituents as assigned by the Team Director.
- Prepares and completes accurate and timely administrative reports and duties as assigned by the Team Director.
- Participates in organizational events, collaborates on projects with other members of senior leadership and works collaboratively with external entities to enhance the visibility of the organization and further the rights of individuals with disabilities.
- Carries out other such duties as may from time to time be required.
- Member of the Florida Bar. Member of the Florida U.S. District Courts and the 11th Circuit Court of Appeals.
- Government clearance by the United States Government Office of Personnel Management is required for this position.
- At least 5 years of significant litigation experience in state and federal court to include client contact, complex motion or appellate practice and litigation through jury or non-jury resolution.
- Knowledge of current state and federal law, regulations, court and administrative procedure as well as rules of professional conduct.
- Ability to communicate professionally orally and in writing in English, including a working knowledge of correct grammar, punctuation, spelling, sentence structure and legal citation.
- Ability to effectively communicate with clients, advocates, attorneys, experts, and other relevant professionals.
- Able to provide effective supervision of staff, demonstrated ability to analyze complex problems, develop effective solutions and implement recommendations.
- Knowledge of management principles and strategic planning, organizational skills to manage multiple priorities and meet internal and external deadlines.
- Sound professional judgment and ability to interface effectively with staff at all levels and maintain productive working relationships. Ability to work as a member of a team, specifically in an interdisciplinary team with other professionals.
- Excellent legal research and writing skills.
- Experience working with and/or sensitivity to the legal rights of people with disabilities, especially in institutional settings.
- Proficient with Microsoft Windows and Office (including Word, PowerPoint, Outlook and Excel) and Adobe Acrobat Pro.
- Availability to travel, sometimes on short notice, throughout Florida, including rural areas.
- Carries out other duties as may from time to time be required.
Preferred Qualifications:

- Leadership and executive responsibilities within a public organization, non-profit organization or law firm.
- Knowledge of and experience working with people with disabilities.
- Usually works in an office environment, but this position will require work in non-standard workplaces such as state institutions, nursing homes, assisted living facilities, and group homes.
- Valid driver's license or State identification and ability travel to work related meetings, hearings, facilities and settings where clients reside.
- Expected to travel within and outside the state as necessary.
Supervisory Responsibility:
- Assigned senior attorneys, staff attorneys, and coordinators.
- Paralegals and assigned regional staff.
- Others as assigned by the Executive Director.
