The Litigation Associates are responsible for monitoring high risk/litigation/title issue accounts to minimize potential client or Cenlar losses. These positions serve as a liaison between clients, upper management and attorneys, support day to day management of client initiatives that impact the Foreclosure, Bankruptcy and Post Sale Department. Some activities include but are not limited to developing reports, conducting research, attending client meetings and state/county hearings or mediations as required.
Responsibilities:
- Recognizes and makes recommendations to facilitate appropriate course of action to mitigate potential exposure
- Manages compensatory process to GSEs from receipt of invoice to resolution
- Manages servicer billing process from receipt of demand until resolution
- Drafts appeals of compensatory fees and servicer demands
- Researches accounts where compensatory exposure exists to determine delays and cause
- Knowledge of the individual state statutes and laws which impact state timelines
- Interprets and understands state statutes and laws
- Maintains current knowledge and understanding of FNMA and FHLMC servicing guides and timelines
- Prepares and distributes monthly management and executive reports
- Works closely with Compliance to keep late-stage default aware of relevant changes to guidelines and/or expectations
- Assesses liability to clients and GSE for delays as it relates to Compensatory fees
- Performs audits on Foreclosure, Bankruptcy, REO and claims files to assess liability for delays
- Understands and interprets servicing contracts
- Periodically assesses Policy and Procedures and advises management on improvement opportunities
- Attends client meetings and provide updates related to compensatory fees
- Participates in off-site due diligence reviews
- Attends all scheduled mediation hearings telephonically or in person which requires some travel
- Reviews workout packages to ensure package is complete for loss mitigation review
- Works closely with loss mitigation for resolution prior to mediation hearing
- Prepares and obtains reinstatements, pay offs, payment histories, Brokers Price Opinion/Appraisals, denial letters and or offers
- Frequently travels to attend state/county hearings or mediations as a regular part of business
- Completes other duties and projects as assigned by management
- Appropriately assess risk when business decisions are made, include but not limited to compliance and operational risk. Demonstrate consideration for Cenlar's reputation as well as our clients, by driving compliance with applicable laws, rules and regulations, adhering to Policy, applying sound ethical judgment regarding personal behavior, conduct and business practices, and escalating, managing and reporting control issues, as well as effectively supervise the activity of others and create accountability with those who fail to maintain these standards
Qualifications:
- Bachelor's degree or equivalent experience
- Attorney or previous legal experience preferred
- Minimum of 5 years mortgage default experience
- Excellent communication skills; oral and written
- Thorough knowledge of FHA/VA; FNMA/FHLMC servicing guidelines and requirements
- Familiar with foreclosure and bankruptcy laws in a multi-state portfolio
- Detail oriented ability to successfully manage multiple priorities, and possess the ability to meet deadlines
- Strong analytical skills
- Strong writing skills
- Able to work in fast paced environment.
- Ability to manage workload to meet deadlines
- Working knowledge with Microsoft Office, spreadsheets and software applications
- It is critical that you have an understanding of the following:
- Requirements under the Real Estate Settlement Procedures Act (RESPA), specifically general servicing standards and loss mitigation practices
- Requirements under the Service members Civil Relief Act (SCRA), specifically protections for Service members
