Elliot Legal is seeking a Litigation Associate to independently manage a caseload of commercial, business, and real estate litigation matters at our Fort Lauderdale office. This is a full-time, in-office position — no hybrid or remote work.

This is a role with real ownership, built for an attorney ready to run their own files — not one looking to support from the background. The attorney we hire will manage cases from intake through resolution: appearing and arguing hearings, taking and defending depositions, running discovery, and driving case strategy with minimal day-to-day supervision. If you want your own caseload, direct client contact, and regular courtroom time, this position will accelerate your career.

Compensation: $75,000 to $85,000 per year, commensurate with experience.

Origination bonus: 10% of revenue collected on client matters originated by the attorney independent of firm resources and marketing, payable pursuant to a separate written compensation agreement.

Responsibilities:
  • Independently manage a docket of civil, commercial, and real estate litigation matters from intake through trial
  • Appear and argue motions, evidentiary hearings, and calendar calls in state and federal courts throughout South Florida
  • Draft complaints, motions to dismiss, motions for summary judgment and other dispositive and non-dispositive motions, discovery requests and responses, and opposition briefs
  • Take and defend depositions; prepare clients and witnesses for testimony
  • Develop and execute case strategy; manage all deadlines and case files in Clio
  • Conduct legal research (Westlaw/LexisNexis) supporting motions, briefs, and strategy decisions
  • Negotiate with opposing counsel and pursue favorable resolution where it serves the client's interests
  • Communicate directly and proactively with clients on case status, strategy, and expectations
  • Second-chair (and, as experience allows, first-chair) trials and arbitrations

Requirements:
  • Active membership in The Florida Bar, in good standing, with no history of discipline
  • Minimum two (2) years of civil litigation experience
  • Courtroom hearing experience required — must be able to appear and argue motions and evidentiary hearings independently
  • Demonstrated ability to manage your own caseload with minimal supervision — you have been the attorney responsible for the file, not solely a supporting drafter
  • Experience taking and defending depositions
  • Strong drafting skills: complaints, motions to dismiss, motions for summary judgment and other dispositive and non-dispositive motions, discovery requests and responses, and opposition briefs
  • Annual billable hours requirement: 1,600 hours
  • Familiarity with Clio (or comparable practice management software)
  • Reliable transportation and ability to travel to hearings throughout South Florida (Broward, Miami-Dade, and Palm Beach counties)

Preferred Qualifications:
  • Commercial and business litigation background (contract disputes, LLC/partnership disputes, fraud claims)
  • Real estate litigation exposure (partition actions, landlord-tenant/evictions, lis pendens, quiet title)
  • Admission to the U.S. District Courts for the Southern and Middle Districts of Florida, or willingness to obtain
  • Arbitration experience (AAA)
  • First-chair trial or arbitration experience
  • Spanish proficiency a plus
