About the role:
The Legal Counsel – Privacy and Product will work cross-functionally and proactively and provide practical legal advice to mitigate risk and ensure that An Online Sports Betting and Online Sportsbook Company products comply with privacy-related laws and regulations, that An Online Sports Betting and Online Sportsbook Company marketing efforts comply with all applicable laws and regulations including consumer protection laws, and that An Online Sports Betting and Online Sportsbook Company data privacy and security policies and practices comply with all applicable laws and are maintained to reflect evolving best practices.

Responsibilities:
  • Develop a comprehensive understanding of the personal data An Online Sports Betting and Online Sportsbook Company collects, uses and stores.
  • Work cross-functionally to proactively mitigate risk associated with current and emerging privacy-related laws and regulations in the United States and Canada.
  • Manage outside counsel to address issues relevant to privacy-related laws and regulations.
  • Review products, features, platforms and initiatives to provide practical legal risk mitigation strategies for products across multiple jurisdictions.
  • Provide and coordinate legal advice across complex and multifaceted legal issues such as data protection and privacy, data governance, consumer protection, e-commerce, payments, information integrity and other legal and regulatory frameworks applicable to An Online Sports Betting and Online Sportsbook Company products.
  • Apply knowledge of and ensure compliance with relevant consumer protection and marketing laws, including Telephone Consumer Protection Act (TCPA), Fair Credit Reporting Act (FCRA), CAN SPAM, Canada's Anti-Spam Legislation (CASL) and Unfair, Deceptive or Abusive Acts or Practices (UDAAP).
  • Provide privacy and data security subject-matter expertise and guidance to cross-functional legal colleagues (including employment, litigation, and commercial counsel), information security, product and marketing teams.
  • Assess privacy-related technology and draft processes to improve the operations of the privacy team.
  • Draft and coordinate external-facing privacy policies, notices and disclosures and manage/update internal policies and procedures to ensure compliance with laws bearing on privacy and cybersecurity.
  • Collaborate with information security team to scope and perform periodic data privacy risk assessments, mitigation and remediation, including data control design and monitoring, as well as the mitigation of privacy and security risks.
  • Maintain responsibility for privacy impact assessments and data subject access request responses.
  • Remain up to date on relevant consumer protection, privacy and data security laws and regulations (including gaming regulations), as well as on technological developments, threat vectors, and evolving industry standards to ensure an ongoing ability to provide sound compliance advice.
  • Review and advise the business regarding new products and product features related to advertising technologies (ad tech).
  • Support cross-company projects involving personal information.
  • Draft and review legal documents including vendor agreements and data protection amendments to include privacy and information security controls.
  • Identify privacy training needs; develop and deliver training.
  • Review and analyze privacy queries from business teams.
  • Contribute to continuous improvement in privacy compliance.
  • Provide legal support for incident management policy/procedures and periodic table-top exercises.

Essential Functions:
  • Must be able to stand or sit and operate computers and other technological devices for extended periods of time

Qualifications:
  • 3+ years of combined, relevant experience in law firms, governmental agencies, and/or in-house legal departments. Prior in-house experience preferred.
  • Experience in gaming or other highly regulated industries a plus.
  • Admission to practice law in a U.S. State and eligible to practice law in New Jersey as in-house counsel.
  • Gaming license registration as required by applicable jurisdictions.
  • CIPP/US or CIPP/C certification strongly preferred.
  • Experience providing pragmatic and actionable advice to clients on various legal risks and obligations under privacy and data security laws in the United States and Canada.
  • Developed and implemented external privacy notices.
  • Experience advising on privacy and data security in commercial transactions.
  • Advised on and managed internal policies and procedures on data use, security, and privacy.
  • Fluency translating legal advice into actionable guidance for innovative product, information and security, and business teams. Product counseling experience is a plus.
  • Experience driving, prioritizing, and effectively managing cross-functional initiatives, and an ability to both work independently and with large multi-stakeholder teams.
  • Possess strong analytical and communication skills.
  • Is diligent, proactive, collaborative, and has demonstrated excellent legal and business judgment and strategic thinking.
  • Sound and practical business judgment, intellectual creativity, strong ethical compass, and problem-solving skills.

Licensing Requirements
As an online gaming company, An Online Sports Betting and Online Sportsbook Company is required to comply with state gaming regulations which includes licensing obligations. Applicable employees must be licensed by at least one jurisdictional agency, although certain positions require licensing by multiple agencies. Failure to become licensed or maintain licensure with each agency as required for the role may result in termination of employment.
