Summary:
The District's Legal Counsel is responsible for administering the overall legal functions of the School District, including providing legal advice to the Superintendent, Cabinet and District Leadership Team. The Legal Counsel represents the School District in court hearings and administrative proceedings, and provides day to day advice and counsel to central administration, principals and assistant principals on a variety of legal matters, including Constitutional law, special education law and employment law. The Legal Counsel also coordinates the development and revision of Board of Education policies.

Responsibilities:
  • Provide day to day advice and counsel to the Superintendent, Cabinet, building administrators and central administrators on a variety of legal matters impacting students, staff, schools and the district.
  • Review contracts, intergovernmental agreements and memorandums of understanding to be signed by Superintendent, Board of Education and other administrators.
  • Provide legal training to District Leadership Team and other staff on new and revised laws, court cases, district policies, and other compliance matters.
  • Review, revise and draft proposed Board policies, regulations, and exhibits.
  • Provide legal guidance to the special education department and building administrators on special education matters; attend IEP-related meetings if a family's lawyer is involved; represent the District in special education administrative complaints and investigations conducted by outside agencies/organizations.
  • Attend Board of Education meetings and executive sessions; advise Board of Education on legal matters and parliamentary procedures.
  • Work with the Communications Department to review pending legislation, edit statements to school communities, and assist with Communications on legal matters.
  • Provide legal guidance to the human resources department; advise on representation at the district in grievance arbitration hearings, and employment actions. Oversee responses to public record requests and complex student record requests.
  • Work with the Risk management department, including evaluation of proposed student activities and consultation with the District's insurance pool.
  • Participate in professional development activities to keep abreast of school law developments.
  • Manage use outside legal counsel, including oversight of court litigation and expenditure of District funds.
  • Provide representation in court and other administrative processes, including truancy cases, expulsion hearings, Office for Civil Rights reviews and complaints, subpoenas, etc.
  • Supervise Executive Assistant, equity council, and Paralegal.
  • Perform other duties as assigned.

Qualifications:
Required:
  • Must have a valid Colorado Law License.
  • Other advanced academic credentials: Juris Doctorate degree
  • Minimum of five years experience in: Education law, employment law, and/or representation of public entities.
  • Must have a valid Colorado driver's license.
  • Completed and submitted BVSD online application.

  • Advanced knowledge of education law (federal and state).
  • Ability to work respectfully with a variety of people in complex situations.
  • Ability to develop trusting relationships to enhance Human Resources functions.
  • Strong planning, organization, motivation management and evaluation skills.
  • Strong communication, collaboration and people skills.

Salary Information:
Salary Range 22: $158,151.00 - $237,230.00
