Why does the job exist?
This job exists to provide the Tax Fraud Investigations Division (TFID) with a dedicated attorney who can be appointed as a Special Prosecutor on criminal tax cases throughout the New Mexico Judicial Districts where such authority is granted. The role is essential to ensure that complex tax fraud cases are effectively prosecuted by a legal professional with the specialized expertise required to navigate tax law and financial crime litigation.

How does it get done?
This position serves as a Special Prosecutor or assist in the prosecution of criminal tax cases-may be appointed as a Special Prosecutor or work directly with the respective District Attorneys Office to prosecute criminal tax cases. This includes drafting charging documents, preparing court filings, representing the state in court proceedings, and ensuring that criminal tax laws are effectively enforced throughout the appropriate judicial districts.

Who are the customers?
The customers include the Tax Fraud Investigations Division, Taxation and Revenue Department, recipients of State, local and tribal revenue, citizens of New Mexico

Ideal Candidate:
The ideal candidate will have seven (7) years of experience in the practice of law in the following areas:
  • Working with the Special Agents to prosecute offenses
  • Engaging in criminal litigation, indictments, jury trial, sentencing
  • Advising on legal strategy and complexities, and develop priorities
  • Recommending charging decisions and propose dispositions
  • Preparing appropriate pleadings, briefs and other court documents

Applicable certifications may include but are not limited to:
  • Certified Public Accountant (CPA)
  • Certified Fraud Examiner (CFE)

Minimum Qualification:
Juris Doctorate degree from an accredited school of law and two (2) years of experience in the practice of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license.

Employment Requirements:
All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA).

Must possess and maintain a valid New Mexico Driver's License. Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification within six (6) months of date of hire as a condition of continued employment. Must be current with all tax reporting/payment. Employment is subject to pre-employment criminal background check to include fingerprint checks and is conditional pending results.

Working Conditions:
Office setting, exposure to Visual/Video Display terminal (VDT) and extensive personal computer and telephone usage with extended periods of sitting or standing. Must be able to lift 25 lbs. Occasional but essential working in loud noise areas in an office setting. Required to frequently meet deadlines with severe time constraints. Continuous interacting with the public requires occasional irate customers. Frequent multiple demands from several people.
