Job Summary:
WCF Mutual Insurance Company (WCF) is looking for a skilled and initiative-taking In-House Insurance Coverage Attorney to join our dynamic legal team. This role is critical in managing and mitigating legal risks by providing expert counsel on complex insurance coverage issues and disputes. The successful candidate will work closely with our claims, underwriting, and executive teams to ensure consistent, legally sound, and timely decision-making regarding policy interpretation and claim resolution.

Qualifications:
  • Juris Doctor degree from an ABA-accredited law school.
  • Active membership in good standing with the Utah State Bar.
  • At least five years of experience in the fields of commercial and workers' compensation claims administration and litigation.
  • In-depth knowledge of insurance policies, coverage issues, and local/federal insurance laws and regulations.
  • Exceptional analytical and problem-solving abilities.
  • Strong oral and written communication skills, with the ability to articulate complex legal issues clearly to non-legal personnel.
  • Proven negotiation and dispute resolution skills.
  • Ability to manage a diverse and demanding caseload independently and efficiently in a time-sensitive environment.
  • Proficiency in legal research databases (e.g., Lexis+) and standard legal software.

Essential Job Functions:
  • Analyze and Interpret Policies: Conduct detailed analysis and interpretation of various insurance policies (e.g., property, liability, auto, business, and workers' compensation) to determine coverage rights and obligations.
  • Draft Coverage Opinions: Prepare comprehensive coverage opinions, reservations of rights letters, denial letters, and disclaimer letters for internal stakeholders with respect to complex claims.
  • Manage Coverage Disputes & Litigation: Oversee and actively manage insurance coverage disputes and litigation from inception through resolution, including strategy development, motion practice, discovery, and trial.
  • Negotiate Settlements: Lead or assist in settlement negotiations, mediations, and arbitrations to resolve coverage issues efficiently and cost-effectively.
  • Collaborate with Claims Department: Provide ongoing legal guidance and support to claims adjusters and other internal teams during claims investigations to ensure compliance with "good faith" obligations and proper documentation.
  • Manage Outside Counsel: Coordinate with and manage external legal counsel for specialized or out-of-state litigation, ensuring alignment with company strategy and managing associated costs.

Accountability & Requirements
  • Conduct Legal Research: Stay abreast of changes in federal and state insurance laws, regulations, and case law to advise the company on potential impacts and compliance measures.
  • Provide Training: Develop and deliver training to internal departments (claims, underwriting) on best practices for claims handling, risk management, and regulatory compliance.
  • Draft Legal Documents: Prepare and review a wide range of legal documents, including pleadings, motions, briefs, contracts, and other correspondence.
  • Establish credibility within WCF and in the insurance community.

Working Conditions:
This position is based in an office environment with adequate temperature and lighting control. There are no known hazardous or unpleasant conditions caused by noise, dust, or other environmental factors. There are potentially high-stress situations that require meeting deadlines. The employee must meet the job attendance requirements for this position.

WCF Insurance offers an extensive compensation package. Benefits include Medical, Dental, and Vision insurance, company paid life insurance, 401K with a generous 6% employer match and additional benefits such as an Employee Assistance Program (EAP) and time off to volunteer in the local community. All employees earn 4 weeks of vacation in their first year. The minimum salary for this position starts at $134,215. There is the ability to increase stating pay depending on experience and education.
