Position Overview:The Immigration Attorney – Labor Certification Specialist will be responsible for managing all aspects of PERM Labor Certification cases from intake through filing and adjudication.
You must be highly organized, proactive, and comfortable operating within structured workflows, reporting systems, and strict compliance standards.
Core Responsibilities:
PERM & Employment-Based Immigration
- Prepare and file PERM Labor Certification applications (ETA 9089)
- Conduct and document recruitment efforts in compliance with DOL regulations
- Draft recruitment advertisements and review posting documentation
- Ensure full compliance with Department of Labor (DOL) requirements
- Manage Prevailing Wage Determinations (PWD)
- Coordinate audits and supervised recruitment responses
- File I-140 petitions and coordinate with adjustment of status or consular processing teams
- Advise employers on wage requirements, job classifications, and compliance risks
- Conduct employer intake consultations
- Evaluate job descriptions and minimum requirements for compliance
- Assess business necessity documentation
- Identify potential audit triggers and mitigate risks
- Provide legal strategy for complex employment-based cases
- Maintain accurate case documentation in case management software
- Meet internal turnaround deadlines
- Collaborate with intake and paralegal teams
- Ensure all case notes, attorney recommendations, and compliance documentation are properly recorded
- Participate in structured reporting and case review systems
Qualifications:
Required:
- Juris Doctor (JD) from accredited law school
- Active Bar License in good standing (any U.S. state)
- 3+ years experience handling PERM Labor Certifications
- Strong understanding of:
- DOL recruitment requirements
- Prevailing wage process
- ETA 9089 filing procedures
- I-140 employment-based petitions
- Audit response strategy
- Experience managing employer clients
- Strong attention to detail and deadline management
Preferred:
- Experience handling EB-2 and EB-3 cases
- Experience with RFE and audit responses
- Spanish fluency
- Experience in high-volume environments
