Frenkel Lambert Weisman & Gordon, LLP is a well-established multi-state law firm concentrating in the representation of mortgage lenders, loan servicers, investors, and other creditors in all aspects of creditors' rights litigation. We are currently seeking an experienced foreclosure/Creditors' rights attorney admitted to practice in the State of New York to join our growing legal team. Offices are located in NYC (Broadway), Bay Shore and Williamsville, NY

Position Summary:
The successful candidate will possess substantial experience in creditors' rights and mortgage foreclosure litigation. Appellate experience is a plus. This position requires exceptional legal research, analytical, and persuasive writing skills, as well as the ability to manage appellate matters from inception through disposition.

Qualifications:

Admission to practice law in the State of New York (required).
Minimum of two (2) years of foreclosure experience.
Demonstrated experience handling creditors' rights and mortgage foreclosure matters.
Appellate experience a PLUS
Strong legal research and writing skills.
Experience drafting appellate briefs (a PLUS)
Ability to analyze complex legal issues and develop effective strategies.
Excellent organizational, communication, and time-management skills.
Ability to manage multiple matters while meeting court deadlines.

Responsibilities:

Handle all aspects of creditors' rights matters.
Manage a caseload of residential mortgage foreclosure and creditors' rights matters.
Review and analyze case files, loan documents, title reports, pleadings, and other legal documents.
Draft, review, and file pleadings, motions, memoranda, affidavits, discovery, and other legal documents.
Handle motion practice, including preparing and responding to dispositive and non-dispositive motions.
Appear in court for conferences, hearings, motions, and other proceedings as required.
Conduct legal research and prepare written legal analysis regarding foreclosure and creditors' rights issues.
Communicate effectively with clients regarding case status, litigation strategy, deadlines, and resolution options.
Negotiate with opposing counsel regarding settlements, loss mitigation issues, dismissals, and other case resolutions.
Monitor and comply with court rules, statutory requirements, procedural deadlines, and client guidelines.
Review and respond to discovery and oversee discovery-related matters.
Analyze title and lien issues and coordinate with title companies and other professionals when necessary.
Identify potential issues affecting the enforceability, standing, priority, or prosecution of a creditor's claim.
Prepare cases for judgment, sale, and post-judgment proceedings.
