Position Overview:
The Disciplinary Enforcement Attorney serves as legal counsel to the SOAR Disciplinary Committee and represents the Committee in disciplinary investigations, administrative proceedings, hearings, and related litigation arising under the SOAR Access to Justice Program's licensing, ethics, and professional accountability framework.

The attorney is responsible for presenting evidence, advocating for the enforcement of the organization's Code of Conduct and Ethics, and representing the Disciplinary Committee in matters involving alleged violations by licensed Qualified Administrative Representatives (QARs), Qualified Regulatory Practitioners (QRPs), licensed agencies, and other credentialed individuals operating under the SOAR Access to Justice Program.

Working independently from investigative personnel, the Disciplinary Enforcement Attorney provides legal representation to the Committee throughout disciplinary proceedings while ensuring that investigations, hearings, and enforcement actions are conducted in accordance with organizational policies, procedural fairness, and applicable law.

Primary Responsibilities:
  • Represent the SOAR Disciplinary Committee during disciplinary hearings and proceedings.
  • Review investigative reports and evidence submitted by investigators and committee members.
  • Present evidence, witness testimony, and legal arguments supporting disciplinary actions.
  • Recommend disciplinary sanctions consistent with the SOAR Code of Conduct and Ethics.
  • Prepare disciplinary pleadings, notices, legal memoranda, settlement agreements, and hearing documents.
  • Advise the Committee on procedural matters and due process requirements.
  • Represent the Committee in judicial or administrative proceedings related to enforcement of organizational disciplinary decisions, when appropriate.
  • Coordinate with the Chief Compliance & General Counsel, Legal Director, and Committee Chair regarding disciplinary matters.
  • Assist in drafting and updating disciplinary procedures, ethics policies, and enforcement protocols.
  • Promote consistency, fairness, and accountability in disciplinary enforcement.

Authority:
The Disciplinary Enforcement Attorney acts as legal counsel for the SOAR Disciplinary Committee and advocates for the enforcement of disciplinary actions authorized by the Committee under the organization's governing policies and procedures. The position is responsible for presenting the Committee's case during disciplinary proceedings and defending Committee decisions in any authorized appeals or related legal proceedings.

Qualifications:
Applicants should possess:
  • Juris Doctor (J.D.) or equivalent qualifying law degree.
  • Active license to practice law in at least one U.S. jurisdiction, where required for the services performed.
  • Experience in administrative law, professional regulation, litigation, ethics, employment law, or regulatory enforcement.
  • Excellent legal writing, advocacy, negotiation, and litigation skills.
  • Strong understanding of due process principles and professional responsibility.
  • Commitment to fairness, ethics, and impartial enforcement.
