Basic Job Purpose/Function
DPA I:
Provides representation on behalf of the State in district court matters, including gross misdemeanors, misdemeanors, probation violations, and traffic infractions.
DPA II:
Provides representation on behalf of the State in felony criminal cases and juvenile matters, or provides civil representation on behalf of the County. The DPA II classification is distinguished from DPA I by the greater complexity of the nature of cases and assignments and by close to moderate supervision, direction and/or assistance from higher level attorneys than DPA I. A minimum of three (3) years of law practice experience is required.

DPA III:
Provides representation on behalf of the State in felony criminal cases and juvenile matters, or provides civil representation on behalf of the County. The DPA III classification is distinguished from DPA I and II by the greater experience required, including significant Juvenile and/or Superior Court jury trial and/or courtroom experience, by the complexity and seriousness of cases and assignments, and by moderate to low levels supervision, direction and/or assistance from higher level attorneys. The Attorney III position may be assigned lead or informal supervisory responsibility.

Essential Job Duties:
DPA I:
  • Represents the State in district court cases. Responsibilities include researching legal bases for complaints and cases filed to determine legal sufficiency, reviewing and preparing physical evidence, interviewing witnesses, requesting further investigation by law enforcement as necessary, evaluating cases for disposition, preparing charges to be filed, negotiating plea agreements, and appearing on behalf of the State in hearings and jury trials.
  • Drafts legal pleadings including information and/or criminal complaints, jury instructions, trial briefs, motions in limine, probable cause statements.
  • Consults with law enforcement regarding their investigations when requested and advises law enforcement about legal issues related to the criminal cases.
  • Maintains current knowledge of the substantive, procedural and evidentiary laws of the State of Washington, federal constitutional law, and procedures of the district, juvenile, superior and appellate courts.
  • Fill in for other prosecutors as needed.

Additional Job Duties:

Dpa Ii:
Criminal:
  • Represents the State in Prosecuting Felony and Juvenile Cases. Responsibilities Include Researching Legal Bases for Complaints and Cases Filed to Determine Legal Sufficiency, Reviewing and Preparing Physical Evidence, Interviewing Witnesses, Requesting Further Investigation by Law Enforcement as Necessary, Evaluating Cases for Disposition, Preparing Charges to Be Filed, Negotiating Plea Agreements, and Appearing on Behalf of The State in Hearings and Jury Trials.
  • Drafts Legal Pleadings Including Information And/or Criminal Complaints, Jury Instructions, Trial Briefs, Motions in Limine, Probable Cause Statements.
  • Represents the Department of Corrections in Revocation Proceedings or Other Legal Hearings for Violations of Felony Supervision or Placement. Reviews Notice of Violation Reports. Prepares Documents as Needed to Request Arrest Warrants. Issues Subpoenas for And Presents the State's Case at Hearings. Drafts Orders for Superior Court for Disposition of Violators.
  • Consults with Law Enforcement Regarding Their Investigations when Requested and Advises Law Enforcement About Legal Issues Related to The Criminal Cases.
  • Maintains Current Knowledge of The Substantive, Procedural and Evidentiary Laws of The State of Washington, Federal Constitutional Law, and Procedures of The District, Juvenile, Superior and Appellate Courts.
  •  Fill in For Other Prosecutors as Needed in Both Felony and District Court Matters.

Civil:
  • Represent the County in The Defense and Resolution of Civil Law Cases and Issues; Minimize County's Risk and Liability; Litigate and Negotiate Civil Cases and Contracts.
  • Confer With, and Offer Advice and Counsel to County Officials and Employees; Apply Legal Expertise in A Variety of Legal Fields Including Labor & Employment, Administrative, Contract, Tort, Tax, Forfeitures, Public Records, and Other Fields of Civil Law Which Apply to County Government.
  • Perform Legal Research and Prepare Written and Oral Opinions on Various Legal Problems or Issues.
  • Review and Process Requests for County Records, Drafts of Contracts and Resolutions, Requests for Payment, and Draft County Codes.
  • Represent Interests of State in Certain Child Support and Paternity Cases.
  • Represents Interests of County in State and Federal Administrative Hearings and Claims.
  • Fill in For Other Prosecutors.

Dpa Iii:

Requirements/minimum Qualifications
Dpa I
Graduation from A Recognized and Accredited School of Law or Completion of The Rule 9 Law Clerk Program and Admission to The Bar of The State of Washington.
Ability to Perform Legal Research; Analyze and Apply Legal Principles, Facts, Evidence, and Precedents to Legal Problems; Present Law, Facts, Evidence, and Arguments Clearly and Logically in Written and Oral Form; Work Harmoniously with Law Enforcement and Court Personnel and Maintain Good Public Relations.

Dpa Ii
  • Graduation from A Recognized and Accredited School of Law or Completion of The Rule 9 Law Clerk Program and Admission to The Bar of The State of Washington.
