But that's not all! We offer an attractive compensation package, including additional pay differentials for selected candidates, ensuring that your dedication and hard work are recognized:
- Out-of-state differential: Selected candidates residing outside of New Mexico can benefit from a generous pay differential upon hire and beginning when they are licensed to practice law in New Mexico. The differential amount is paid separately from the base hourly pay and is negotiable but shall not exceed the maximum pay of the assigned job classification's salary range without the Chief Public Defender's prior approval.
- Temporary recruitment differential: All selected candidates, regardless of where they reside, may be eligible for a temporary recruitment pay differential that is paid separately from their base rate of pay for up to one year from the date of hire, and the date they are licensed to practice law in New Mexico. The pay differential is administered separately from base/hourly pay and is negotiable up to 15% of the hourly pay rate, with the Chief Public Defender's approval.
- Geographical Pay Differential: For those selected and living within or around Roswell, New Mexico, a Geographical Pay Differential, separate from their base pay, is eligible upon hire. Selected candidates are expected to work in the Roswell office, unless other arrangements are agreed to. The current pay differential for eligible Roswell employees is $3.75/hour, or $7,800.00 annually, and is negotiable up to $3.75, dependent on the selected candidate's qualifications and work experience.
- Licensing Fees and Bar Dues: The LOPD will pay or reimburse selected candidates for these fees and dues in accordance with agency policies and procedures.
- All selected candidates are eligible for travel reimbursement in accordance with the State of NM travel and per diem rules, ensuring you're supported while traveling as you work tirelessly for your clients and upon hire.
- Public Defender 2: Average pay ranges from $32.70Hourly to $37.07
- Public Defender 3: Average pay ranges from $43.91Hourly to $55.00
- Public Defender 4: Average pay ranges from $49.66Hourly to $57.95

Essential Functions:
Criminal Defense Attorney PD2, PD3 or PD4:
Incumbent will be considered for a Public Defender 2, 3, or 4 classification. Classification will be determined at the time of hire based on applicant's job related qualifications and agency critical need.
Public Defender 2 (PD2):
- Attorneys at this level will handle a variety of misdemeanors and may assist in juvenile cases and youthful offender cases.
- May assist higher level attorneys with complex cases.
- Work is performed under the direction, guidance and supervision from more experienced colleagues and supervisor/manager.
- Will conduct plea bargaining when appropriate with District Attorneys and other parties to establish agreements to resolve cases.
- Will attend seminars, training classes and review current professional literature to maintain and develop professional skills and knowledge.
- Drafts/reviews, proposes and prepares reports and legal documents.
- Attorneys at this level should be able to represent clients in all misdemeanors or juvenile cases and low to medium level felonies with limited supervision.
- Provides guidance and mentoring to lower levels attorneys and law clerks.
- Works under the direction and guidance provided by higher level Attorneys and/or Managing Attorney.
- Will conduct plea bargaining when appropriate with District Attorneys and other parties to establish agreements to resolve cases.
- Will attend seminars, training classes and review current professional literature to maintain and develop professional skills and knowledge.
- Drafts/reviews, proposes and prepares reports and legal documents.
- Positions at this level handle felony cases such as burglaries, drug crimes, property crimes and probation violations with limited supervision.
- May handle more complex level felonies with some guidance/direction from a higher level attorney/managing attorney.
- Has acquired sufficient knowledge and/or experience to handle an appellate caseload.
- Has knowledge and experience to prepare appellate briefs and argue cases before the Court of Appeals and Supreme Court with some direction from higher level Attorneys.
- Provides guidance and advice to lower level attorneys.
- Works independently and is able to recognize and resolve complex issues related to the caseload.
- Will attend seminars, training classes and review current professional literature to maintain and develop professional skills and knowledge.
- Drafts/reviews, proposes and prepares reports and legal documents.
- Performs related and other duties as assigned.
