Position Summary:
The Office of the General Counsel advises the Commissioner and others within the department on all aspects of tax and administrative law. The Office seeks an experienced attorney for its administrative law operations. The Counsel II, drafts, negotiates and reviews DOR's Request for Responses ("RFR") and contracts. Drafts, negotiates and reviews DOR's Data Exchange Agreements with other state agencies and entities, as well as the IRS. Acts as a legal advisor on DOR's data initiatives and IT procurement projects. Assists with the review of any unauthorized access or use of DOR information to determine if notification letters are needed. Assists DOR's Federal/State Exchange with disclosure and IRS requirements. Maintains and updates DOR's delegations of authority. Responds to administrative law questions, including questions related to departmental policies, conflict of interest laws, use of SSNs on forms, visa issues, etc. Performs related work as required.

Statement of Duties and Responsibilities (not all-inclusive)
  • Adheres to Bureau's established rules as to record keeping.
  • Provides legal advice and assistance to groups in DOR, such as Administrative Affairs Division (AAD), ANF-IT Support and Tax Administration.
  • Works with other state agencies and entities to ensure that the Department complies with all procurement laws and regulations.
  • Works with other state agencies and entities to determine if data exchanges are authorized and ensure that, when applicable, all data exchange agreements include DOR's confidentiality and security requirements.
  • Assists with interpretation of IRS disclosure rules and ensures DOR is in adherence with IRS Pub. 1075.
  • Maintains, updates and drafts DOR's delegations.
  • Works with ADD to review all unauthorized accesses or uses of DOR information to determine if breach notification letters are needed.
  • Works with executive staff to respond to non-tax inquiries from DOR, state agencies and other third parties.

Required Qualifications:
  • Knowledge of theory, principles and practices of law.
  • Knowledge of procedures followed in courtroom and administrative proceedings.
  • Knowledge of the methods and ability to conduct legal research and technical report writing.
  • Ability to read and interpret legal documents and apply the law, rules and regulations governing agency operations.
  • Ability to exercise discretion and sound judgement.
  • Ability to interact effectively with diverse groups of people.
  • Ability to communicate effectively, both verbally and in writing, to clearly and concisely express thoughts and develop ideas in a logical manner.
  • Ability to use a computer to conduct research, manage databases, and produces written documents.
  • Ability to lead or work with cross-functional projects teams.
  • Ability to manage multiple projects and project teams.
  • Ability to exercise discretion in safeguarding information through compliance with rules of disclosure.
  • Ability to supervise, including planning and assigning work according to the nature of the job to be accomplished, the capabilities of subordinates, and available resources; controlling work through periodic reviews and/or evaluations; determining the need for and recommending disciplinary actions.
  • As part of the Future of Work initiative, the agency is adopting a hybrid work model. Hybrid work is a mix of in-office work and telework. This position will work remotely some days and in-person on other days.

An external candidate recommended for a position with the Department of Revenue will be subject to a background check that includes checks for: state and federal tax compliance; child support compliance; education verification; Massachusetts CORI checks; criminal background checks in state(s) of current and previous residence/employment; validation of eligibility to work in the United States; and national fingerprint-based criminal background checks.

Qualifications:

Minimum Entrance Requirements: Applicants must have a Juris Doctor (JD) degree, admission to the Massachusetts Bar and (A) at least three years of full-time, or equivalent part-time, professional experience in the practice of law.

Incumbents may be required to have a current and valid Motor Vehicle Drivers License at a Class level specific to assignment.
