Description:

This position is counsel to policyholders and the Exchange in all legal proceedings, including trial and arbitration. It provides legal representation of Exchange policyholders to protect their interests in the defense of personal injury and/or property damage lawsuits. The position also provides legal representation for the Exchange to defend and/or protect its interest in uninsured motorist claims, underinsured motorist claims, medical payment reimbursement, small claims appeals, subrogation actions, and other legal actions.

Responsibilities:
  • Analyzes cases to determine all pertinent facts and develop appropriate legal theories/strategies in the defense of lawsuits. Identifies potential exposure to policyholders or the Exchange. Develops and implements appropriate discovery plans and motions, as needed. This includes propounding and answering written discovery, subpoenas, and review of records, taking depositions, drafting and opposing motions, retaining and conferring with experts, and obtaining witness statements
  • Prepares for, attends and defends all limited and unlimited jurisdiction court proceedings including trials. Will also prepare for, attend, and defend mediations and arbitrations. Researches and prepares motion, trial and appellate briefs and argues motions, and appeals at the lower appellate courts.
  • Communicates to management an overview of the case facts. Identifies issues of liability and damages, sets forth legal defenses and strategy recommendations, provides discovery plans, and provides opinions on value or any other pertinent information. Regularly communicates with policyholders and claims representatives regarding development of specific cases. Communication includes providing written summaries of discovery, depositions, records, and significant developments on cases.
  • Participates in negotiation and settlement of cases on behalf of the Exchange or its policyholders with outside parties/entities. Collects settlement amounts.
  • Position requires solid understanding of the law and its proper application to the facts of a case. Incumbent evaluates cases for both liability and potential exposure. Makes decisions in collaboration with Claims on the legal strategy, including developing and executing motions and discovery plans appropriate for the defense of the case.

Qualifications:
  • JD Required
  • 4-6 years Insurance defense law preferred
  • Solid understanding of insurance contracts required. Insurance defense experience preferred.
  • Good grasp of trial procedures and the rules of the evidence.
  • Valid Driver's License, acceptable Department of Motor Vehicles record and minimum liability insurance - Issued by State Required

The starting pay range for this position is:
$109,500.00 - $146,200.00
Additionally, for full time positions, you will be eligible to participate in our incentive program based upon the achievement of organization, team and personal performance.
