Description:
General Purpose:Under the general supervision of the City Manager and in close coordination with the Municipal Judge and Court Administrator, performs attorney work with latitude for the use of initiative and independent judgment in the Municipal Court. Work primarily involves representing the City's interest in criminal matters involving city code and state law violations.

Main Job Tasks and Responsibilities
- Represent the City and its departments in Municipal Court, to include:
- Preparing criminal and civil administrative cases for trial.
- Preparing pleadings and other legal documents.
- Respond to defendant's motions and pleadings as necessary.
- Participating in evidentiary hearings and conducting limited discovery
- Actings as the City's attorney in Municipal Court proceedings.
- Review citizen-initiated allegations of Class C misdemeanor offenses and determine if charges should be filed based upon legal sufficiency, evidence standards, and equitable principles of fairness and justice.
- Prosecute Class C misdemeanors in the Lakeway Municipal Court of Record and appeals to the County Court at Law and other appellate courts as necessary; research, review, and analyze criminal and civil statutes and case law; assist Court personnel as required.
- Advise officers and code enforcement officers regarding legal issues pertaining to detection, investigation, and prosecution of criminal cases; provide training to police officers regarding changes in criminal law and procedure; and provide training to police officers to help prepare them to testify more professionally and effectively in court proceedings.
- Communicate with victims, explaining their rights at all stages of the criminal proceedings, getting their input regarding the impact of the crime against them, restitution options, and sentencing recommendations.
- Comply with the Texas Crime Victims Act, as set forth in Chapter 56, Texas Code of Criminal Procedure.
- Comply with continuing legal education requirements established by the State Bar of Texas and all other requirements to maintain law license.
- Contribute to team effort by performing other related duties as assigned.
- Conveys a positive, professional image by action, communication, and appearance.
- Exhibits regular, reliable, and punctual attendance, which is an essential function of the job.
Education and Experience:
- Graduation from an accredited law school.
- License to practice law in the State of Texas.
- Membership in good standing with the State Bar of Texas.
- Minimum of five (5) years of previous criminal law experience, preferably as a prosecutor for a city or county.
- Previous municipal law experience preferred.
Certifications, Licenses and Special Requirements
- Proof of citizenship and/or eligibility to legally work in the United States.
- Maintain valid Texas Driver's License with satisfactory driving record, as defined by City policy.
Knowledge, Skills, and Abilities:
- Knowledge of the Microsoft Office Suite Software.
- Knowledge of criminal law, judicial procedure and rules of evidence.
- Knowledge of municipal codes, applicable state laws, and federal statutes.
- Knowledge of required knowledge, skills, abilities and experience; able to explain and demonstrate, with or without reasonable accommodations, that the essential functions of the job can be performed.
- Ability to communicate effectively in the English language when speaking or writing.
- Ability to establish and maintain effective working relationships with City Council, employees of the City, court officials, attorneys, interest groups, crime victims, and the general public.
- Ability to effectively respond in stressful or high-pressure environment.
- Ability to meet deadlines and perform multiple tasks under pressure.
- Ability to learn new concepts and apply knowledge appropriately.
- Ability to act in the best interest of the City, maintain confidentiality and continually strive to improve self and job performance.
- Ability to perform effectively while working independently or as part of a team.
Working Conditions and Physical Requirements
- Work environment is confined to an office or a court room setting, where noise and temperature levels are moderate.
- Hours are typically set but may vary with night court.
- May be subject to occasional stressful situations and physically threatening subjects in court.
- Work occasionally requires travel, including over-night stays, involving training and conducting City business.
- The work is sedentary work which requires exerting up to 10 pounds of force occasionally and/or negligible amounts of force frequently or constantly to lift, carry, push, pull or otherwise move objects.
- Must be able to sit or stand for long periods performing job functions.
- Must possess mental acuity for attention to accuracy and detail.
- Must see in the normal visual range with or without correction.
- Must hear in the normal audio range with or without correction.

Pays
$45,000/year. No benefits. Schedule will consist of six (6) - eight (8)
court dates per month. Three dates will be "day" court dockets held on
Fridays. Three will be "night" court dockets. Approximately 20 - 35
hours per month based upon the size of the court docket. The court
docket schedule is already set for all of 2025 and 2026.
