The State of New Hampshire, Department of Health and Human Services, Bureau of Child Support Services has a full-time vacancy for Child Support Attorney II.Summary:
As legal counsel to the Bureau of Child Support Services (BCSS) BCSS attorneys work closely with district office and field staff in establishing, modifying, and enforcing domestic and international orders for paternity and child and medical support. BCSS attorneys delve deep into family law ensuring compliance with State and Federal laws, BCSS policies, and the effective administration of the IV-D program. BCSS attorneys appear before every Family Division in the State, as well as represent the Bureau in administrative hearings, before the legislature, and before the Superior Courts.
Your Experience Counts: Each additional year of approved formal education may be substituted for one year of required work experience and/or each additional year of approved work experience may be substituted for one year of required formal education.
Minimum Qualifications: Education/Experience: Equivalent combination of 9 years of education and experience after completion of high school. Education and experience must include 4 years in the active practice of law.
License/Certification: Valid driver's license and/or access to transportation for statewide travel.
Other Requirements:
- Juris Doctorate from an American Bar Association recognized law school.
- Must be an active member of the New Hampshire Bar Association and in Good Standing.

Ability to prepare legal cases and briefs, and to represent an agency in legal proceedings.

Responsibilities:
Initiates, responds to, and assumes full responsibility for all stages of litigation before the Family Division, Probate Courts, and Superior Courts in matters as directed by Title IV-D of the Social Security Act. Represents the State in establishing court orders for paternity, child support, and medical support, including administrative hearings, divorce and family hearings, post-trial hearings, modifications, post-appellate litigation, informal mediation, and formal mediation.
Processes national and international paternity, medical, and child support cases, serving as subject matter expert in Hague Convention and Uniform Interstate Support Act cases. Responds to and researches applicable state, interstate, national, and international law; communicates with foreign child support agencies; facilitates information disclosure between stakeholders; and educates courts on case processing. Drafts and responds to pleadings to register, modify, or enforce international and national orders.
Supervises, educates, and collaborates with BCSS child support officers and field staff to ensure timely processing and enforcement of paternity, child, and medical support orders within IV-D program parameters, BCSS policies, and state law. Participates in drafting policies and procedures, assists in training development, and supports case investigation, drafting proposed orders, responding to subpoenas, and representing officers at hearings.
Ensures compliance with Title IV-D of the Social Security Act by staying informed of IV-D directives, explaining IV-D requirements to stakeholders, developing collaborative relationships with courts, investigating and evaluating cases, and reviewing non-state and private-party cases for IV-D compliance.
Develops and implements departmental programs in collaboration with BCSS administration to meet IV-D program goals, providing legal guidance across units such as Review and Modification, Inmate Program, Central Registry, Interstate, and Policy Units. Participates in work groups to review policies, adopt new practices, and implement updates.
Assumes full responsibility for all stages of litigation before the Administrative Appellate Unit (AAU), including drafting pleadings, organizing hearings, preparing staff, conducting discovery, and reviewing cases for compliance with policies, laws, and regulations.
Monitors pending New Hampshire Supreme Court cases, reviews appellate pleadings' impact on BCSS policies, communicates with the Attorney General, and provides guidance to staff regarding enforcement of orders pending appeal. Educates BCSS staff on the implications of Supreme Court orders.
Responds to and processes requests for 91-A Right to Know information and other case information, evaluating requests against IV-D requirements and confidentiality statutes. Prepares redacted documents, monitors confidential disclosures, and educates courts and stakeholders on confidentiality restrictions. Communicates with the Ombudsmen and Governor's Office concerning public or stakeholder concerns within the IV-D framework.
Participates in legislative review and development related to family law matters, including child support calculation and enforcement, guidelines, duration, paternity, medical support obligations, and modifications. Drafts, reviews, and monitors legislation, educates staff on legislative impacts, and attends relevant hearings.
