Job Overview:
The Assistant Vice President, Associate General Counsel provides legal support and strategic advice to the organization on matters related to collections, recovery, and litigation and arbitration. This role enforces contractual rights and recoups outstanding balances, often in the FINRA arbitration forum, while managing litigation risk and supporting business objectives.

Responsibilities:
Legal Counsel & Risk Management
  • Advise business units on legal issues related to collections, recovery strategies, litigation, and arbitration.
  • Interpret and apply laws and regulations impacting the collection of outstanding receivables and loans, including statutes of limitation, probate, and bankruptcy issues that may arise.
  • Identify and address potential counterclaims, cross claims, and/or third-party claims and reputational impact of litigation and arbitration.
  • Assess litigation risk and develop strategies to mitigate exposure.

Litigation Oversight
  • Manage and oversee affirmative litigation involving the recovery of accounts receivable and loan balances.
  • Manage and oversee defensive litigation involving counterclaims, cross claims, and/or third-party claims for, among other things, wrongful termination, defamation, breach of contract, and tortious interference.
  • Negotiate and finalize pre-arbitration settlements.
  • Identify and pursue opportunities for mediation.
  • Represent LPL in FINRA arbitration and/or litigation end-to-end where appropriate.
  • Where necessary, retain and direct outside counsel, review pleadings, briefs, and discovery responses.
  • Develop litigation strategies aligned with business goals and regulatory requirements.
  • Confirm and enforce FINRA arbitration awards in state or federal court.

Collections Compliance
  • Ensure collection practices comply with applicable laws and internal policies.
  • Advise on statutes of limitation, tolling, probate, and bankrtupcy issues that may arise. Support operational teams in resolving complex collection disputes and threats of litigation.

Contract & Document Review
  • Draft and review demand letters, settlement agreements, litigation-related correspondence, and other legal documents.
  • Negotiate resolutions to disputes and claims.
  • Coordinate revision of contracts and loan documents, as needed, to support collectability in the event of default.

Regulatory & Policy Guidance
  • Monitor changes in laws and regulations affecting collections and litigation.
  • Provide training and guidance to internal stakeholders on compliance and risk management.

Requirements:
  • Juris Doctor (JD) from an ABA-accredited law school
  • Minimum 5–8 years of legal experience, preferably in financial services or banking.
  • Strong background in litigation and negotiation, arbitration and collections experience a plus.
  • Experience managing outside counsel and litigation budgets.
  • Strong case management and decision-making skills.

  • Advise our internal business partners about risk areas and provide legal guidance regarding firm policies and procedures.

  • Ability to manage multiple complex matters simultaneously.
  • Strong critical thinking and decision-making skills.
  • Confidence in first-chairing a case end-to-end with the ability to delegate to outside counsel on more complex matters.
  • Strong knowledge of litigation and arbitration procedures and regulatory frameworks.
  • Promptly summarize and report on matters for management review and consideration.
  • Handle internal and external client and outside counsel contacts in a timely, professional, courteous, and confidential manner.
  • Adapt quickly to dynamic environments and independently manage multiple litigation and arbitration caseload assignments and deadlines, plus other assignments, cases and projects within the team.
  • Proficient computer knowledge in Microsoft Office suite applications, including Word, Excel, PowerPoint, as well as other litigation-related data systems.
  • Familiarity with FINRA arbitration, award, confirmation, and enforcement process.
  • General understanding of debtors' exams, probate law, and bankruptcy stay proceedings and proofs of claim.
  • Experience with compliance programs.
  • General understanding of securities industry and litigation.
  • Prior in-house counsel experience in a financial institution.

Pay Range:
$132,793-$221,321/year

Actual base salary varies based on factors, including but not limited to, relevant skill, prior experience, education, base salary of internal peers, demonstrated performance, and geographic location.
