Why does the job exist?
Enforce compliance with the Workers' Compensation Act with respect to insurance coverage, safety, unfair claims processing, fraud and other matters. The Enforcement Bureau Chief oversees investigations and prosecution of violations of the Workers' Compensation Act.

How does it get done?
Manage and direct activities of the enforcement bureau under supervision of general counsel; enforce violations of the N.M. Workers' Compensation Act and associated rules though administrative prosecutions before the agency director or designee and in New Mexico District Court, if necessary; familiarity with administrative and district court procedures and rules of evidence; advise the director and general counsel on insurance compliance and enforcement cases and exercise discretion on case prosecution; supervise enforcement bureau staff (2 investigators and 1 paralegal); act as lead attorney on administrative and district court proceedings to enforce compliance with the Workers' Compensation Act.

Ideal Candidate:
Minimum 3 years litigation experience; minimum 2 years supervisory experience. Preferred experiences: experience with workers' compensation law, insurance law, and/or regulatory law; familiarity with rules of civil procedure and evidence; comfortable handling matters in a court setting; experience with reviewing and writing legal documents.

Minimum Qualification:
Juris Doctorate degree from an accredited school of law and five (5) years of experience in the practice of law, to include one (1) year of supervisory experience. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Employment Requirements:
Must possess and maintain a valid New Mexico Drivers License. Must possess and maintain a current Defensive Driving Course Certificate from the State of New Mexico or must pass and receive Defensive Driving Course Certification as a condition of continued employment.

All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA).

Working Conditions:
Work is performed in an office setting with exposure to visual/video display terminal (VDT) and extensive computer and telephone usage. Some sitting, standing, reaching and bending may be required. Extended periods of time interacting with the public. Litigation in administrative agency and courtroom settings. Ability to lift 25-30 lbs. Ability to complete assignments with a high level of accuracy within strict time constraints. Operation of a State vehicle is required in the course of completing job duties.
