The New Mexico Division of Vocational Rehabilitation (NMDVR) is a state-run agency dedicated to assisting individuals with disabilities in achieving employment success. Through services such as vocational counseling, job placement assistance, training and education, assistive technology, and support services, NMDVR aims to enhance the employability and independence of people with various disabilities. Provide legal advice and representation to the Agency and Agency staff concerning all applicable federal and state laws and regulations

How does it get done?
The attorney in this position is responsible for providing legal advice and representation concerning numerous areas of state and federal law, including but not limited to the State Personnel Act, Inspection of Public Records Act, Open Meetings Act, State Procurement Code, State Rules Act, Per Diem & Mileage Act, the Individuals with Disabilities Education Act, the Rehabilitation Act of 1973, the ADA and FMLA. Other areas of practice include but are not limited to; contract law, employment law, labor relations law and general civil litigation before administrative and court tribunals.

Who are the customers?
The State of New Mexico, Division of Vocational Rehabilitation and Agency staff.

Ideal Candidate:
Experience in the following areas is preferred:
4 or more years of experience representing and advising clients on state and federal laws effecting government entities including but not limited to; the Inspection of Public Records Act, the Open Meetings Act, the NM State Personnel Act, and the State and Federal Procurement Codes, the Civil Rights Act.

4 or more years of experience in the practice of administrative law, including representing government agencies before administrative tribunals and/or hearing officers.

4 or more years of experience representing clients in State and/or Federal Court.

4 or more years of experience in contract drafting, contract review for legal sufficiency, and contract interpretation, implementation of agency policy and procedure, policy and procedure review for legal sufficiency.

Knowledge of laws and regulations specific to individuals with disabilities including the Rehabilitation Act; the Individuals with Disabilities Education Act, and the Americans with Disabilities Act.

Minimum Qualification:
Juris Doctorate degree from an accredited school of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Employment Requirements:
All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA).

Must travel. If you are able to drive must go through the Defensive Driving Course (DDC), and receive a certificate to operate a State of New Mexico vehicle.

Working Conditions:
Work is performed in an office setting: late hours, weekends, on-call and callback work may be required. Will be exposed to regular periods of video display terminal and keyboard usage and stressful situations. Travel is required. Possible exposure to irate clientele. Incumbent will work under stress and frequent time constraints.
