Why does the job exist?
To perform legal and investigative work in the enforcement of state laws, rules and regulations overseen by the State Ethics Commission.

The position applies a broad knowledge of the law and an understanding of agency programs to achieve the Commission's goals, in particular the Commission's guidance and enforcement duties regarding the laws within the Commission's jurisdiction. The position is involved in agency enforcement actions in state court, agency adjudications, the formulation and issuance of agency advisory opinions and advisory letters, and agency rulemakings.

How does it get done?
Supports investigations and enforcement actions under the Revised Uniform Law on Notarial Acts (RULONA), including preparing charging documents, reviewing investigative files, advising investigators, and participating in administrative hearings related to notarial misconduct.

Represents the agency in civil litigation, including enforcement proceedings under the Campaign Reporting Act, the Governmental Conduct Act, the Nondisclosure of Sensitive Personal Information Act, and the Procurement Code, by participating in case investigations and evaluations, drafting complaints, researching and drafting motions and responses, making and defending discovery requests, attending, taking, and defending depositions, and attending and participating in court hearings.
Participates in Commission administrative cases by assisting the Executive Director in jurisdictional determinations and the General Counsel in probable cause determinations, settlement negotiations, and participation in administrative proceedings.

Drafts and participates in agency rule-making proceedings, legislative bill analysis, and legislative reports.

Provides ethics advice, training, and outreach by preparing training materials; participating in presentations to public agencies, associations, and stakeholder groups; and responding to advisory requests from public officers, public employees, lobbyists, candidates, contractors, and members of the public.

Contributes to development of Commission guidance and educational materials such as model codes of ethics, compliance resources, summaries of advisory opinions, and updates for public-facing platforms.

Performs other duties as assigned, consistent with the Commission¿s broad jurisdiction and statutory responsibilities, and may be assigned to any matter within the agency¿s authority.

Ideal Candidate:
Juris Doctorate degree from an accredited law school.

Licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15.301.2 NMRA)

Experience in legal research, drafting briefs and memoranda related to civil matters in New Mexico or federal court.

Minimum Qualification:
Juris Doctorate degree from an accredited school of law. Must be licensed as an attorney by the Supreme Court of New Mexico or qualified to apply for limited practice license (Rules 15-301.1 and 15-301.2 NMRA). Employment Requirements:
All Attorney classifications must be and remain licensed as an attorney, in good standing, by the Supreme Court of New Mexico, or licensed as an attorney and in good standing by the highest court of another state and eligible pursuant to the limited license provisions (See Rules 15-301.1 and 15-301.2 NMRA).

Working Conditions:
Work is performed in an office setting: late hours, weekends, on-call and callback work may be required. Will be exposed to regular periods of video display terminal and keyboard usage and stressful situations. Travel is required. Possible exposure to irate clientele. Incumbent will work under stress and frequent time constraints.
