Description:

The Office of General Counsel is recruiting for an Agency Attorney Interne to function as Attorney Interne within the Litigation and Program Counseling Unit of the Office of Legal Affairs.

The Litigation and Program Counseling Unit (LPCU) represents the Agency in litigation and provides legal counsel to the majority of program areas within the New York City Department of Social Services/Human Resources Administration, including those that administer cash assistance, emergency assistance, and Supplemental Nutrition Assistance Program (SNAP) benefits, Medicaid, home care services, services for survivors of domestic violence and clients living with HIV/AIDS, and supportive and career services. LPCU represents the Agency in Article 78 and other proceedings in Supreme and Civil Court, provides litigation support to the New York City Law Department on class action and other major litigation and appeals, and provides legal counsel to program areas on the impact of complex laws and regulations on the administration of benefits and services to low-income New Yorkers and vulnerable populations.

The duties of an Agency Attorney Interne include:
Provide legal counsel to the Family Independence Administration, the Medical Assistance Program, the HIV/AIDS Services Administration, the Home Care Services Program, the Employment and Support Services Administration, Customized Assistance Services, the Office of Client Advocacy (including the Office of Refugee and Immigrant Affairs, the Office of Disability Affairs, and the Office of LGBQTI Affairs), the Office of Domestic Violence and Emergency Intervention Services, Fair Fares NYC, and other DSS/HRA program areas.

The Office of General Counsel/Office of Legal Affairs is recruiting one Agency Attorney Interne who will:
  • Draft legal opinions in response to requests for legal guidance, interpret laws and regulations, and analyze the impact of proposed amendments to federal, state and local laws and regulations. Draft litigation documents, such as affidavits, motion papers, memoranda of law and answers to pleadings.
  • Represent the Agency in Supreme and Civil Courts and in certain administrative hearings. Court matters include Article 78 proceedings, small claims and other civil actions and responses to subpoenas.
  • Provide litigation support to the NYC Law Department in the Agency's defense of federal class actions, and other major litigation and appeals.
  • Performs other related tasks.

Minimum Qualifications:
Graduation from an accredited United States law school as defined in the Rules of the New York Court of Appeals (Sections 520.3 or 520.5) or admission to the New York State Bar.
