Job Description and Duties:
Under general direction of the Chief Counsel, the Deputy Chief Counsel, or the Assistant Chief Counsels, the Attorney III represents A Government Entity in court proceedings, at forensic and State Personnel Board proceedings, and provides legal advice to A Government Entity on the more difficult and sensitive issues involving the administration of all A Government Entity facilities. The Attorney III must operate with broad discretion and with minimal direction towards achieving A Government Entity's objectives.

Performs legal research and provides legal advice to A Government Entity clients on broad and specialized areas of law within a difficult or sensitive program. Responds to questions about mental health funding and fiscal controls. Provides responses to the Governor's Office, the Health and Human Services Agency and State control departments. Provides legal expertise on various A Government Entity programs which may involve unsettled points of law or rapid evolving areas of law, regarding but not limited to, legislation, regulations, A Government Entity policy, Public Records Act requests, and subpoenas. Work involves contract negotiations, drafting and reviewing contracts, and employee immigration law. Performs legal research and provides legal advice on complex issues involving, but not limited to, patient privacy, employee privacy, intellectual property, potential conflicts of interest, Cal OSHA audits, risk management, data sharing, and advice on departmental contracts. Travel may be required as a part of these specified duties.

Other legal functions related to the operation and administration of all A Government Entity facilities. Other duties and tasks as assigned by the Chief Counsel, Deputy Chief Counsel, and the Assistant Chief Counsels.

Working Conditions:
Hybrid telework is available based on operational needs and is subject to change, with a current minimum two in-office workdays per week requirement. In-office work requirements for new employees may increase during the first thirty (30) days of employment based on training needs.

Special Requirements:
The position(s) require(s) a(n) California State Bar License License. You will be required to provide a copy of your license prior to being hired.

Desirable Qualifications:
In addition to evaluating each candidate's relative ability, as demonstrated by quality and breadth of experience, the following factors will provide the basis for competitively evaluating each candidate:
  • Experience in the following legal areas: mental health law; employment law; administrative law; civil litigation; privacy; Public Records Act; subpoena; public contracting; regulations; legislation.
  • Hearing and/or trial experience.
  • Experience working with outside counsel.
  • Knowledge of rules of evidence, probate code, welfare and institutions code, and penal code.
  • Well-developed analytical and communication skills, both verbal and written, superior interpersonal skills, and tact.
  • Well-developed legal research, writing, analysis, and advocacy skills.
  • Legal analytical and research skills for reviewing difficult, complex, and sensitive rulemaking actions by state agencies.
  • Ability to use good judgment in following established program procedures.
  • Superior work habits, the ability to complete work under deadlines, and ability to adjust to shifting priorities.
  • Experience drafting, reviewing, and revising legal documents such as pleadings, contracts, letters, memos, and legislation.
  • Demonstrated ability to maintain effective working relationships with colleagues, program staff and management, staff of other state and federal agencies, and client advocacy organizations, while working independently and as part of a team.
