The Service to State Agencies Section provides a full range of legal service, including litigation before State and federal tribunals, to a number of State agencies or agency components. The Section also provides legal services to a number of occupational licensing boards and commissions and to local government agencies through oral and written opinions to city and county attorneys, registers of deeds and other local elected officials.

Primary Purpose of the Position
This position provides counsel to and representation to the Department of State Treasurer (“DST”), Retirement Systems Division (RSD) and State Health Plan (SHP), and their components. The position also represents DST in employment actions and collaborates with other attorneys within DOJ who represent DST in litigation.

Representation of and providing legal advice to the DST and its components, including the State Health Plan, requires a high degree of familiarity with and ability to self-study and learn the laws governing these retirement and health plan entities. These laws are technical, complex, and subject to significant federal regulation. This attorney demonstrates an ability to deal with frequent technical interpretation questions in written and oral opinions, which are based on the retirement and health laws themselves, social security laws, Internal Revenue Code provisions and regulations promulgated by the Internal Revenue Service, equitable distribution laws, probate and guardianship laws, bankruptcy laws, and many other relevant laws, regulations and constitutional provisions. This attorney must demonstrate an ability to assist in the drafting of statutes, administrative rules, and technical manuals published by this agency. This attorney, also, demonstrates thorough familiarity with the Administrative Procedures Act, the Public Records Act, the Open Meetings Act, the State and federal rules of civil procedures, and all other State and federal statutes, regulations and rules governing administrative and court proceedings.

This attorney, in collaboration and with mentorship of two senior DST attorneys, participates in complex, class action litigation on behalf of DST. All of the responsibilities assigned to this attorney are handled in collaboration with the other two attorneys, and matters of simple to intermediate complexity are to be handled independently with minimal supervision. This attorney is the litigation counsel, either independently or as a member of a litigation team, for this client handling important litigation, including complex cases involving the SHP and RSD.

If selected for this position, a new salary will be recalculated taking into consideration the quantity of relevant education and experience, funding availability, and internal equity. Based upon these factors, a pay increase MAY or MAY NOT result.

The Starting Salary for a New Hire to This Position is Limited to the Recruitment Range of $84,878 to $100,179. Client funded. Salary offers for the selected candidate are based on the candidate's education and experience related to the position, as well as our agency budget and equity.

Knowledge, Skills and Abilities / Competencies:
  • In-depth understanding of federal and state statutes, rules, and case law related to the duties of the North Carolina Department of State Treasurer.
  • Thorough knowledge of North Carolina rules of procedure, court and practice (administrative, trial and appellate).
  • Ability to draft, analyze, interpret and act upon statutory and regulatory provisions.
  • Ability to conduct complex litigation in administrative tribunals and trial and appellate courts.
  • Ability to draft and review contracts to govern complex transactions, including IT products and services, between the Department of State Treasurer and vendors.
  • Ability to express arguments and conclusions logically and correctly, both orally and in writing.
  • Ability to use good judgment and discretion in exercise of job responsibilities.
  • Good negotiation skills.

  • Ability to maintain effective working relationships with persons contacted in course of work.

Minimum Education and Experience Requirements:

Licensed to practice law by the North Carolina State Bar and three years of progressively responsible professional legal experience. Note: GS 114-2 and 114-6 make it the duty of the Attorney General of NC to represent the State of North Carolina in all litigation unless another statute specifically states otherwise.
