Job Description:Serves as Attorney to the Promise Scholarship Program (Program) under the Georgia Education Savings Authority. Under limited supervision, provide advice, counsel, support and technical assistance to the executive management and staff of the Program. Serves as the Program liaison for legal and regulatory compliance, and maintains working knowledge of all applicable laws, statutes, etc., both state and federal, governing the operation of the Program. Serves as legal advisor to the Program's Board and prepares proceedings, as necessary. Reports to the Vice President of the Georgia Education Savings Authority.
Job Responsibilities:
- Drafts program regulations.
- Drafts and negotiate various agreements.
- Supports the Promise Scholarship Program leadership team.
- Maintains current working knowledge of all pertinent federal and state laws, court rulings, rules and regulations and Program policies and procedures to ensure correct interpretation and uniform implementation of the laws, rules, and regulations.
- Provides sound advice and counsel on matters concerning laws, regulations, liability, litigation, contracts, and/or risk management.
- Responds to inquiries regarding legal determination, open records requests, and requests to review and comment on proposed legislation in a timely manner.
- Apply knowledge of statutes to Program operations, facts of case or dispute, and/or factual scenarios.
- Develops and implements legal processes to ensure response to the legal needs of the Program.
- Conducts research and assures that policies are accurate and reflect the correct interpretation of laws, rules, regulations, etc.
- Reviews all pertinent legislation pending before the Georgia General Assembly, or at the federal level, and communicates to management the potential impact of proposed legislation on the Program's mission and personnel.
- Reviews contracting processes upon request.
- Drafts any legislation as applicable.
- May perform legal tasks on behalf of Georgia Student Finance Commission, as assigned.
Minimum Qualifications:
The following standards express the minimum background of training and experience DESIRABLE as evidence of an applicant's ability to qualify for this specific position. Other training or experience, if evaluated as equivalent, may qualify an applicant for the position.
- Juris Doctorate from an accredited college or university AND license to practice law in Georgia or eligibility to sit for the next Georgia Bar examination followed by Georgia Bar exam passage and licensure to practice law in the State of Georgia within one (1) year of hiring or reciprocity and one (1) year of relevant legal experience; or one (1) year of experience required at a lower-level Attorney.
- Experience in applicable legal or governmental environment.
- Polished and professional communication and presentation skills. The applicant must be able to represent the Program in professional environments with policymakers, legislators, and other key constituencies.
Preferred Qualifications:
Experience in Contract Negotiation, Education, Employment Law, Statutory Interpretation, and Open Records/Open Meetings Act. State of Georgia government experience is preferred.
Juris Doctorate from an accredited college or university and license to practice law in the State of Georgia or eligibility to sit for the next Georgia Bar examination followed by Georgia Bar exam passage and licensure to practice law in the State of Georgia within one (1) year of hiring or reciprocity and one (1) year of relevant legal experience; or one (1) year of experience required at the lower-level Attorney 1 (LEP020).
