Role Overview:
Under the guidance of the Contract Compliance Attorney, the Attorney Associate Compliance will be responsible for the prequalification, auditing, analysis, and monitoring of INDOT's Local Public Agency (LPA) subrecipients' policies, programs, procedures, projects, and activities for nondiscrimination compliance. This position will provide internal and external guidance for compliance with Title VI and all related statutes, will research and interpret existing and new laws, regulations, and executive orders to guide informed decisions and to reduce risk. This position will also prepare and review various agreements, contracts, and other legal documents, as well as aid in construction compliance reviews when necessary.

This position is located in INDOT's Indianapolis Central Office.

Salary:
This position traditionally starts at an annual salary of $67,314.00. Salary for this position may be commensurate with education and job experience.

A day in the life:
The essential functions of this role are as follows:
  • Ensure agencies receiving federal funding adhere to Title VI and related statutes, regulations, and guidelines, which include reviewing and auditing agencies' Title VI regulatory and reporting activities.
  • Prepare reports and documentation related to Title VI compliance, investigations, and program activities.
  • Communicate with internal and external stakeholders, including the public, other agencies, and advocacy groups, to ensure effective Title VI implementation.
  • Provide guidance and support to agencies on various aspects of Title VI compliance measures, including self-assessments and corrective action plans.
  • Aid in developing and delivering nondiscrimination training programs for staff and other stakeholders on Title VI requirements and best practices.
  • Advises and provides legal support to agency staff on various program and legal areas.
  • May oversee, draft, review, or provide legal advice relating to contracts.
  • Researches, interprets, and provides legal advice in relation to laws, rules, and legal opinions pertaining to agency operations.
  • May draft and review legislation and administrative rules.
  • Utilizes legal resources, dockets, legal files, and official records of relating to legal procedures.
  • Creates, prepares, and distributes documents related to hearings, including orders and decisions.
  • May handle administrative matters and hearings while maintaining appropriate decorum, hear evidence, rule on the admissibility of evidence, and/or make reasoned decisions supported by evidence.
  • May be required to utilize litigation skills and experience relating to agency operations.
  • Organizes and manages caseload in the preparation of hearings and/or litigation.
  • May review pleadings, motions, and discovery.
  • May draft appeals, or briefs, or perform legal writing assignments.

This position is exempt from overtime compensation for additional work hours which may be required to complete essential functions or other assigned work. Exempt employees may work more than 75 hours in a pay period without additional compensation and must report a minimum of 75 hours per pay period of work hours and/or paid leave taken to receive their base biweekly salary.

What You'll Need for Success:
The ideal candidate in this role should minimally have
  • Must be licensed to practice law in the State of Indiana and possess a minimum of 3 years of experience actively practicing law. If previous legal experience includes subject matter expertise in areas of specific strategic needs, lesser experience may be considered.
  • Indiana Bar Admission license in good standing.
  • Knowledge of applicable civil rights laws, rules, regulations, and policies.
  • Excellent communication and interpersonal skills to interact with diverse audiences.
  • Must be a self-starter, be proactive, and work independently without needing constant supervision, direction, or guidance.
  • Ability to identify problems, develop solutions, and implement effective strategies.
  • Ability to manage multiple projects and tasks effectively.
  • Must be eager to learn new skills and remain up-to-date on current laws, rules, regulations, and orders.
  • Demonstrated knowledge and ability to apply relevant statutes, case law, and rules.
  • Ability to effectively communicate both orally and in writing.
  • Ability to successfully utilize a case management system to manage a docket, case information, party information, and serve orders.
  • Strong legal research, writing, and litigation skills.
  • Able to perform essential functions with or without reasonable accommodation.

This role may be utilized in a supervisory capacity based on agency needs.
