Job Summary:
Located in the nation's capital, The Office of the Attorney General (OAG) is the chief legal office of the District of Columbia. OAG enforces the District's laws, works to protect and defend D.C. residents, and provides the highest level of independent legal advice and guidance to District of Columbia government agencies. This position is located in the Legal Counsel Division (LCD).

The Legal Counsel Division (LCD) is responsible for providing legal advice on a broad range of legal issues to the Attorney General and officials and employees in the Executive Office of the Mayor, District agencies, the Council of the District of Columbia, Advisory Neighborhood Commissions, and instrumentalities of the District government. The Division regularly advises on sensitive, complex, and high-priority issues involving constitutional law, statutory construction, the Home Rule Act, administrative law, appropriations, and other legal matters particular to the unique status of the District. It also reviews all draft legislation introduced on the Mayor's behalf, all draft rulemakings from the Executive Branch, and all Council-enrolled bills presented to the Mayor for legal sufficiency to obviate legal objections to them. In addition, the Division is responsible for drafting legal opinions of the Attorney General and performing other duties assigned by the Attorney General or Chief Deputy Attorney General.

Duties and Responsibilities:
The Attorney Advisor is responsible for:
  • Providing rigorous legal analysis and reviewing various legal documents and relevant case law to determine whether execution of proposed actions is supported by law.
  • Examining and analyzing proposed orders, legislation, and other legal documents from various sources for legal sufficiency, both as to form and substance. In addition to formal memoranda, the attorney will consult frequently with officials of various administrative agencies and other government entities to provide informal guidance and advice.
  • Reviewing the legal sufficiency of draft rulemaking and draft legislation to provide comments and propose language that comports with the law.
  • Conducting a continuing review and evaluation of existing District of Columbia and federal statutes and regulations to determine the need for new regulations or amendments, new administrative and enforcement procedures, and providing clarification in instances of ambiguities or conflict with other laws and regulations.
  • Recommending and drafting of new enabling legislation and amendments to existing legislation, for review and approval, as appropriate.
  • Performing other related duties, as assigned.

Qualifications and Education:
The incumbent must have a law degree and be a member of the District of Columbia Bar or eligible for a waiver into the bar. Must remain a member of the DC Bar in good standing throughout tenure as an attorney. Preferred extensive knowledge of applicable District and federal statutes, legislation, rules, regulations, guidelines, and principles, including agency policies and relevant judicial decisions. Substantial skill in the analysis and resolution of difficult legal issues in an orderly, systematic, and effective manner. Skill in interpreting and applying applicable laws, regulations and practices, including agency policies and relevant judicial decisions. At least 6 years of relevant related specialized experience, 1 year of which must have been equivalent to LS-13.

Licenses and Certifications:
The incumbent must be sworn into the District of Columbia Bar within 360 days of his/her initial appointment with the Office of the Attorney General for the District of Columbia.

Working Conditions/Environment:
Work is generally performed in an office setting. Generally, work is sedentary, some walking, handling, and carrying of light to moderately heavy objects (such as case records, briefcases, and exhibits) is required.
