Summary:
This position is located in the Department of Health & Human Services (HHS), A Transforming the Future of Americas Health Care, Offices of Hearings and Inquiries (OHI), Office of Hearings (OH).

As an Attorney Advisor (Hearing Officer), GS-0905-13, you will serve as a Hearing Officer and an Article II appointed adjudicator, be responsible for various appeals authorities within OHI's purview, and provide arms-length Hearing Officer review and decisions in these cases.

Duties:
  • Serves as an Article II appointed hearing officer involving a variety of health care organization types and CMS programmatic areas including disputes over Medicare Advantage risk adjustment data validation.
  • Drafts legal documents such as decisions and orders; performs legal cite research and analyzes legal documents to develop the facts in a case and determine the appropriate course of action for bringing legal questions to resolution.
  • Manages cases and dockets and develops and oversees adjudication procedures for hearing officer appeals.
  • Performs legal analyses and provides legal advice on matters that may impact or be adjudicated within the CMS Office of Hearings.

  • Bar Membership Required: Admission to the bar of any State, territory, Commonwealth of Puerto Rico, District of Columbia, or Federal Court is acceptable. Employees must maintain active bar membership while employed as an attorney with HHS.
  • Selection is subject to approval by the HHS Secretary prior to Appointment.

Experience Requirement for Gs-13: Requires 2 Years of Professional Legal Experience Post Bar Admission, with One Year of Experience Equivalent to The Gs-12 Level.

Bar Membership Requirement: Hhs Attorney Positions Require Current Active Bar Membership. Admission to The Bar of Any State, Territory, Commonwealth of Puerto Rico, District of Columbia, or Federal Court Is Acceptable. Employees Must Maintain Active Bar Membership While Employed as An Attorney with Hhs. Active Bar Membership Is Verified Prior to Appointment.

Education:
Education Requirement: In Addition to Meeting the Qualification Requirements, Hhs Attorney Positions Have a Minimum Requirement of A Juris Doctorate (j.D.) or Bachelor of Laws (ll.B.) from An Accredited School.
