Job Summary: Provides legal advice and counsel to INTRUST Financial Corporation and INTRUST Bank, N.A. on a variety of legal matters. Primary responsibilities include reviewing and revising vendor contracts and other agreements, policies, and procedures, overseeing document retention, assisting with deposit-related issues, advising on consumer compliance and collection matters, and assisting with litigation. Promotes an environment of teamwork within the department and across the bank. Represents INTRUST Bank in all they do in the community and is focused on the development of new business relationships. Must maintain strict standards of confidentiality and perform duties in a manner supporting INTRUST's character qualities.
Essential Functions: All expectations described in the job description's essential functions are necessary to be successful in this role, performed with or without a reasonable accommodation.
- Review, draft, revise, and support negotiation of vendor and other third-party contracts.
- Oversee and modify document retention policies and procedures.
- Assist other department counsel with matters involving deposits and operations including review of procedures, power of attorney documents, trust agreements and small estates affidavits. Provide assistance on fraud issues, including drafting demand letters as necessary. Assist with interpreting tax reporting regulations, and advising on health savings accounts and IRAs.
- Assist collections department with matters involving consumer and business accounts and consumer loans; including advising on personal guarantees and right of setoff.
- Interpret laws and regulations applicable to consumer credit, such as Reg Z, UCCC, FCRA, and SCRA. Support consumer lending areas with respect to foreclosure, repossession, loan acceleration and related matters, including related documents such as auto-debit forms and monthly payment information.
- Support various banking compliance functions by interpreting a variety of banking laws and regulations, reviewing and drafting forms and disclosures, and advising bank personnel in connection with new bank products and services.
- Work with bank personnel on developing and modifying policies, practices, and procedures to conform to legal requirements.
- Manage litigation. While most litigation is primarily handled by outside counsel, this job includes selecting and approving outside counsel, implementing legal holds, conducting investigations, coordinating discovery, providing legal analysis and advice, and liaising with outside counsel.
- Respond to a wide variety of day-to-day requests for legal support, including performing legal research, preparing memoranda, reviewing, and revising documents, and generally providing legal advice.
- Develop a working understanding of supported lines of business and applicable rules to allow for timely responses in a high-volume environment.
- Perform all duties necessary and incidental to the foregoing and such other activities as the General Counsel may assign or authorize.
Education and Experience: Juris Doctor (JD) degree from an ABA accredited law school and a minimum 5 years legal experience required. Experience reviewing and negotiating vendor contracts required. Banking experience preferred. Litigation experience preferred. Document retention experience preferred. Familiarity with tax reporting requirements, HSAs and IRAs preferred.
Required Skills and Knowledge: Ability to handle multiple assignments simultaneously, manage workload, and effectively resolve conflicting priorities. Excellent oral and written communication skills with ability to work in teams and independently. Knowledge sufficient to perform Essential Functions with minimal training. Adaptive to changes in technology and industry innovation. Proficient in Microsoft Applications. Self-starter with strong work ethic.
Required Licenses and/or Certifications: Registered with the Kansas Supreme Court as a licensed attorney in good standing.
Physical Demands: Extended period(s) of time viewing personal computer, sitting, standing, and walking. Occasional lifting up to 25 lbs. Must be able to hear and speak clearly both face-to-face and over the phone. Must be able to use hands to key information and handle objects. The physical demands necessary for this role should be performed with or without a reasonable accommodation.
Working Conditions: This is an in-office position. Normal office conditions. Some travel may be required.
