Purpose of Role:The Associate Counsel, Intellectual Property & Marketing will provide trademark, copyright, and marketing legal support to business units in accordance with his/her responsibilities. The Associate Counsel will help manage An American Sports Equipment Company global trademark and copyright portfolios, and corresponding clearance, prosecution, and enforcement. The Associate Counsel's role will also include counseling the business on marketing and advertising issues.
Your Impact:
- Provide support on a broad range of IP matters, including domestic and international trademark, copyright and design clearance, enforcement, transactions, and domains.
- Conduct U.S. and international clearance searches to determine availability of proposed trademarks, taglines, product names, product designs and other consumer facing content.
- Manage significant volume of trademark prosecution and enforcement matters with U.S. and foreign Intellectual Property offices as well as with third parties. Liaise with, and supervise outside law firms, vendors and internal business partners as needed for pending IP matters.
- Draft legal documents, including cease and desist letters and Notices of Opposition. Contribute to enforcement of UA rights and risk management and mitigation strategy.
- Review advertising and promotional materials across all forms of media. Conduct risk assessments and advise on claim substantiation requirements, right of publicity clearances, and draft disclosures.
- Structure and review Terms and Conditions for marketing promotions, including domestic and international sweepstakes, contests, and other promotions and incentives.
- Draft and negotiate IP licenses (music, product placement, etc.) and marketing agreements with third parties. Prepare and update waivers and releases for experiential marketing activations.
- Advise on legal issues related to generative AI, including IP ownership, content clearance, and responsible use in marketing and product development.
- Provide education and proactive counseling to the business to manage risk and enhance IP protection.
Qualifications:
- Minimum of 5 years of experience in-house or law firm focusing on intellectual property (including trademarks, copyrights, marketing and issue-spotting for patent implications). Preference for candidate with law firm experience.
- J.D. and active member of a state bar in good standing
- Experience with sustainability and/or environmental advertising is a plus
- Experience with Olympics-related advertising is a plus
