A Family Law Firm operating in six states: Illinois, Indiana, Missouri, Michigan, Texas and Wisconsin. We are currently seeking a full-time Foreclosure Attorney for our Michigan Office in Bingham Farms. Our law firm represents creditor rights in Foreclosure, Bankruptcy and Real Estate matters. The successful candidate is expected to add immediate value to the team by assuming various transactional responsibilities. We require candidates who have been licensed to practice law in Michigan for at least 5 years.

General Summary: Ability to handle a high volume caseload consisting of transactional matters regarding foreclosure compliance, eviction proceedings, and title curative remedies as well as state and federal court litigation.

Principal Duties & Responsibilities:
  • Review entire foreclosure file, including title report, to insure legal compliance with state and federal notices
  • Reviews and responds to debt disputes, qualified written requests, and notice of constitutional violations
  • Reviews FDCPA letter, firm demand letters, and reinstatement and/or payoff letters for accuracy
  • Reviews files to determine whether files can proceed judicially or non-judicially and provides options to clients to resolve complex foreclosure issues
  • Reviews title issues, including prior unreleased liens, breaks in chain of title, and probate/deceased borrower concerns, and provides recommendations on how to resolve and insure marketable title
  • Reviews petitions, discovery, motions, and settlement agreements and all other documents to be filed in court
  • Represents client on defense motions, including temporary restraining orders and wrongful foreclosure and/or eviction proceedings
  • Appears for state and federal hearings, depositions, and mediations
  • Provide client with timely updates and responds to communication with clients, borrowers and opposing counsel within 24 hours
  • Advises staff and works collectively with legal support and paralegals in other office(s)

Qualifications:
  • J.D. from an accredited Law School
  • Licensed to practice law in Michigan for at least 5 years and in good standing
  • Licensed to practice law in applicable Michigan Federal District Courts
  • Knowledge of MI Civil Procedure, MI Foreclosure by Advertisement and Judicial Foreclosure, Summary Proceedings for Eviction, and the Fair Debt Collection Practices Act
  • Real Estate Closings/REO experience preferred
  • Bankruptcy experience preferred
  • Related experience preferred

  • Strong verbal and written communication skills
