Diaz Anselmo & Associates P.A. is a certified minority-owned, AV-rated law firm with more than 30 years of experience representing financial institutions, mortgage servicers, and other creditors. With a multistate practice, our firm provides comprehensive legal services in bankruptcy, creditors' rights, foreclosure, litigation, and real estate matters.We are seeking a Bankruptcy Associate Attorney with 2–5 years of experience to join our growing bankruptcy practice. The ideal candidate will have experience representing creditors in bankruptcy proceedings, strong legal research and writing skills, and an interest in developing their practice within an established, collaborative law firm.
This position offers the opportunity to handle substantive bankruptcy matters, gain meaningful courtroom experience, and work directly with experienced attorneys representing institutional clients.
What You'll Do:
- Represent mortgage servicers, financial institutions, and other creditors in Chapter 7, Chapter 11, and Chapter 13 bankruptcy proceedings.
- Draft and prosecute motions for relief from the automatic stay, proof of claims, objections to confirmation, objections to claims, and other bankruptcy pleadings.
- Review and analyze bankruptcy petitions, schedules, Chapter 13 plans, and related filings to identify and protect creditors' interests.
- Handle contested matters, including litigation involving lien validity, claim treatment, and other creditors' rights issues.
- Attend and argue motions at bankruptcy court hearings and participate in related proceedings.
- Conduct legal research and prepare memoranda, motions, briefs, and other substantive filings.
- Evaluate bankruptcy strategies and provide practical legal recommendations to clients.
- Work collaboratively with partners, senior attorneys, paralegals, and support staff to ensure efficient and effective case management.
- Maintain communication with clients regarding case developments, legal strategy, and resolution opportunities.
- Monitor developments in bankruptcy law, federal procedural rules, and applicable local bankruptcy court requirements.
What We're Looking For:
Required Qualifications:
- Juris Doctor (J.D.) from an accredited law school.
- Active membership in good standing with The Florida Bar.
- 2–5 years of legal experience, preferably involving bankruptcy litigation or creditors' rights.
- Familiarity with the United States Bankruptcy Code, Federal Rules of Bankruptcy Procedure, and bankruptcy court practices.
- Strong legal research, analytical, and writing skills.
- Ability to manage multiple matters and deadlines effectively.
- Strong communication skills and professional judgment.
- Ability to work independently while collaborating with a broader legal team.
Preferred Qualifications:
- Experience representing secured creditors, mortgage servicers, or financial institutions.
- Experience handling motions for relief from stay, Chapter 13 plan objections, and contested bankruptcy matters.
- Prior bankruptcy court hearing experience.
- Familiarity with bankruptcy practices in Florida's federal judicial districts.
