- Position Summary: Under the direction of the elected Prosecuting Attorney, this position involves the prosecution of criminal matters in Roscommon County. The Assistant Prosecuting Attorney is responsible for reviewing law enforcement requests for warrants, making charging decisions for both misdemeanor and felony cases, and representing the People of the State of Michigan in all stages of court proceedings.
Responsibilities and Duties:
- Warrant Review and Charging Decisions: Review police reports and evidence from various state and local law enforcement agencies to determine if adequate grounds exist to authorize arrest warrants and determine the appropriate charges (misdemeanor and felony).
- Case Preparation: Conduct legal research, interview victims and witnesses, and develop trial strategies for assigned cases.
- Court Appearances: Appear in District, Circuit, and Probate Courts for arraignments, motions, trials, sentencings, probable cause conferences, preliminary examinations, and other hearings.
- Trial Advocacy: Conduct felony and misdemeanor trials, including jury selection, presenting arguments, examining and cross-examining witnesses, and introducing evidence.
- Legal Drafting: Draft various legal documents, including motions, briefs, and search warrants.
- Negotiation: Participate in conferences with defense counsel and involved parties to resolve pending criminal cases through plea agreements.
- Advising Law Enforcement: Provide legal advice and assistance to law enforcement officers on legal issues, proper procedures, and case preparation.
- On-Call Duty: Serve in an on-call capacity on a rotating basis to respond to urgent requests for arrest and search warrants outside of normal business hours.
Minimum Qualifications:
Minimum Qualifications:
- Juris Doctorate degree from an American Bar Association (ABA) accredited law school.
- Active membership in good standing with the State Bar of Michigan.
- Ability to pass a background check and drug test.
- Roscommon County residency not required, but preferred.
- Must be available on weekends and evenings for on-call responsibilities (on a rotation basis with other prosecutors).
Additional Qualifications:
Knowledge, Skills, and Abilities:
- Comprehensive knowledge of Michigan criminal law, the Michigan Rules of Evidence, and Michigan Court Rules.
- Strong ability to analyze complex legal problems, perform legal research (using resources such as Westlaw), and present findings clearly and logically.
- Excellent oral and written communication skills and the ability to work effectively in a fast-paced, high-stress environment.
- Ability to establish and maintain effective working relationships with county employees, court officials, law enforcement agencies, victims, and the general public.
- Proficiency in standard office software and legal case management systems.
