Job Summary:
Pre-Bar Admission to 3 years' experience Assistant Prosecutor
Under the direction of the Prosecuting Attorney and the Chief Assistant, reviews and authorizes requests for warrants, determines the appropriate charge and prosecutes criminal cases. As an entry level Assistant Prosecutor, is assigned to a District Court docket, covering misdemeanor criminal trial docket, felony preliminary examinations, civil infraction hearings, Juvenile Delinquency, Neglect and Abuse and Mental Commitment Hearings. Prepares and argues motions and appeals as well as assisting, with supervision, in more complex felony matters.

3 years' plus experience Assistant Prosecuting Attorney
Under the direction of the Prosecuting Attorney and the Chief Assistant, must be able to perform the above duties. In addition, as an experienced Assistant Prosecutor, is able to independently manage a court docket while also handling felony cases in Circuit Court as well as District and Probate matters as necessary. Is assigned more complex or sensitive cases including sexual assault, violent crimes, and/or homicides. Is expected to be able to prosecute such matters with limited assistance.

Primary Duties & Responsibilities:
  • Reviews criminal warrant requests from local law enforcement agencies, analyzes police reports, researches the law as necessary to determine applicable statutes and determines whether adequate grounds exist to authorize a warrant. Determines the appropriate charge(s) to be made.
  • Research and prepare criminal cases for trial, motion, sentencing, and other proceedings. Includes the research of applicable law, interviewing victims and witnesses, investigating claims, developing trial strategies, as well as directing law enforcement officers in further investigations.
  • Appears in court for arraignments, motions, trials, sentencing, and other proceedings to represent the Prosecutor. Selects juries, presents arguments, examines and cross-examines witnesses, introduces physical exhibits, confers with Judge and defense counsel on points of law and procedure and argues factual conclusions to a Judge or jury.
  • Works cooperatively with law enforcement officers from various agencies to ensure investigation and reporting of assigned cases are accomplished in accordance with professional and judicial rules and standards. Provides advice and instruction to police agencies.
  • Attempts to resolve and dispose of pending criminal cases by conferring with attorneys, police agencies, and parties involved to reach an agreement on pleas and potential sentences.
  • Drafts motions, briefs, and other legal documents.
  • Research the more difficult legal issues through the use of computer technology and local resources. Assists other Assistant Prosecutors in resolving difficult legal questions.
  • Reviews requests for search warrants and authorizes warrants as appropriate.
  • Serves in an on-call status to respond to request for arrest and search warrants. Provides information and advice to law enforcement on proceedings and issues under investigation and process. May include requests on weekends and holidays.
  • May include other duties, as assigned.

Qualifications:
  • Education: Law degree from an accredited law school.
  • Licensed to practice law in the State of Michigan.
  • Experience: Three years as an Assistant Prosecutor or a closely related capacity.
  • In good standing with the Michigan State Bar.
